Sergeant Peter Rhyne served with 8th North Carolina Regiment, Continental Army during the American Revolution.

8th North Carolina Regiment, Revolutionary War

Peter's records show that he was baptized surname Rein, his military records show him as surname Rhein and his probate records show him surname Rhyne.

Peter was baptized 16 March 1755 by Rev Jacob Lischy at Christ Lutheran Church, York, Pennsylvania, son of Jacob Rein and Elizabeth.[1]

Peter enlisted in Colonel James Armstrong's, 8th North Carolina Regiment in November 1777 as Quartermaster Sergeant.[2] In January 1778 he was Sergeant in Captain John Walsh's Company, 8th North Carolina Regiment,[3] and discharged February 10, 1780.[4]

Peter married Anne Magdalene Wills. There is no extant civil record.

Peter executed his will 21 December 1826 and it was proved 8 July 1828 in Lincoln County, North Carolina.
In The Name of God Amen I Peter Ryhne of the County of Lincoln and State of North Carolina Being of Sound and perfect Mind and Memory Blessed be God I But taking into Consideration that it is Appointed for all Men Once to Die do this 21 Day of December in the year of our Lord 1826 Make and Publish this my Last will and Testament in Manner following that is to Say
First I Recomend my Sole into the hands of Almighty God who gave it & my Body to be Deasently Burred and then
I first give and Bequeath unto my Dearly Beloved Son Simon all the Lands Beloning to this plantation whear on I Now Live and that is also to Say the Werton tract & the __att tract by Estemation 440 acres be the Same mor or Less also My Negro Man Jesse and his wife Suckey & their four Children viz Biney Levi Ginney and Ezekel also all the working tools that Belongs to the place Both the afore said Land and Six Negros and working tools I give to the said Simon and his heirs for Ever with this Reserve that if the said Simon Should Die without Esue [issue] Born in wedLock then the aforesaid Land and Negros is all to fall Back and be Equally Deveded Among all my other Children to Shear A Like
Secontly I give and Bequeth unto my Beloved wife Anney Magdelein my Dwelling hous and all it Contains with all the Out Standing Debts to geather with all the Remains due of my Estate in Land Negros or other property Not here in other wise Bequeathed or willed to my Son Simon and my said wife is to have and to hold all the afore Said Estate Both Real & personal during her Life
therdly I give and Bequeath unto my Sun Michal One Dollar to be all that he gits Out of my Estate and further it is my will that after the Death of my wife all the Estate Remaining is to be Equly Divided among all my other Nine Children

The within Will was proved in Open Court by the Oath of Levi Harris & Admitted to Record. Witness Vardry McBee, CC [Clerk of County Court][9]

Lincoln County probate records of Peter's estate are extant.[10] There also are Gaston County estate records. Following the deaths of executors Daniel Rhyne and Christian Rhodes, Caleb Rhodes and Henry Setzer were appointed administrators of Peter Rhyne’s estate. The estate remained open until widow Anna Magdalene Rhyne died. Rhodes and Setzer made their final report of their administration on 9 May 1856 in Gaston County. The papers are filed as “Peter Rhyne (1856).” Most of the extensive file pertains to a suit by daughter Barbara Froneberger’s administrators who argued that the distribution of her share of her father’s estate was incorrect and inadequate. There also are extensive papers regarding the estate of Paul Froneberger.[11]

There seem to be some children missing for Peter Rhyne and Anne Magdalene (Wills) Rhyne:

1. Michael Rhyne who is mentioned in his father's will as getting $1 and nothing more. Hard to determine which of the many Michael Rhynes there are, but there is a Michael Rhyne who was involved with some counterfeiters in 1823 and one whose wife Catherine petitioned for divorce and alimony in 1828 (articles in the The North-Carolina Star, Raleigh, North Carolina.) Those things might have irritated his father. Hard to say.

2. Simon Rhyne who is mentioned as his 'beloved son' in his father's will. "Our Kin" (p.173) says he married married (Mary?) Polly Houser (North Carolina Marriage Bonds, 1741-1868, #, 18 Oct 1848, Bond # 000075267), but before that he was married to Sarah Lay ("Annals of Lincoln County, North Carolina,"p.108.) (both in "Marriage bonds of Tryone and Lincoln Counties North Carolina, p.105)

3. Elizabeth Rhyne who is mentioned in her father;s will. She married John Joseph (Laughing John) Hoffman in 1796.("Our Kin," pp.17-18 & 173). I would like to be able to connect Elizabeth to Peter Rhyne and Anne Magdalene (Wills) Rhyne.
