Biography

Based on records, it's possible that two or more men are being conflated. Given the complexity of this conflation, this profile intentionally contains extensive research for what might be more than one man.

Benjamin Brand (est 1713 - aft 1759) was the son of Thomas Brand III (abt.1678-1766) of RI. A letter dated 31 Jan 1759 in Wilmington, New Hanover Co, NC, from Peleg Rogers to Thomas Brand of RI, states, "Your Son Benjamin Brand is living & has a wife and six children in this county". Additionally, the letter states, "my wife, Isabell, deceased April ye 25 A D 1754".[1] Peleg's word choice is interesting. It might imply Peleg is informing Thomas that his son Benjamin has a wife and kids, as if Thomas didn't know. It's also interesting it took Peleg almost five years to inform Thomas that his daughter Isabel had passed away.

Wives and children of Benjamin Brand: Errors in the book Vital record of Rhode Island 1636-1850, by James N. Arnold, have led to much misinformation for Benjamin Brand. FamilySearch’s records mirror what is in Arnold’s book. It appears FamilySearch used the book to create their Rhode Island Births and Christenings, 1600-1914 records. The images on said birth records redirect you to unindexed Film #930813 found in Town meeting and vital records vol. 2-4 1706-1819, Westerly, Rhode Island. One must find the actual record themselves. In other words, it does not appear FamilySearch reviewed the primary records when creating the Rhode Island Births and Christenings, 1600-1914 collection.

The actual records indicate that Benjamin and Rebecca Brand were the parents of one child, Amos Brand. Furthermore, actual records indicate that Benjamin and Lucy Brand were the parents of three children; Rebecca, Benjamin, and David. See attached PDF titled Benjamin Brand, Marriage and Birth Records, Westerly, RI.

It is possible that Benjamin was first married to Rebecca, they had one child and that she may have died shortly thereafter. The birth record for Benjamin and Rebecca's child was recorded in 1739. In 1740, Benjamin married Lucy. Birth records indicate Benjamin and Lucy were having children between 1741-1744/5, in Westerly, RI.[2] Then, in 1753, Lucy purchases land and is identified as a "widow, so called". She again is recorded on a deed in 1759, still in Westerly, RI.

The children born in RI appear to have stayed there. Benjamin and Rebecca Brand's child, Amos Brand (1735-1768), was documented in 1757 in RI. Furthermore, Benjamin and Lucy's children were not documented in NC. They married in nearby CT. Meanwhile, in 1759, Benjamin Brand, son of Thomas Brand III (abt.1678-1766), was in New Hanover, NC, along with a wife and six children.

Benjamin Brand (bef 1732 - aft 1790) of Edgecombe Co, NC, has numerous documents showing his activity in Edgecombe, beginning in 1753 and including 1756, 1757, 1759, 1761, 1767, and many more.

Lucy is documented in RI, as a landowner, 1753-1759. Therefore, Lucy is not the mother of Brand children born in Edgecombe Co, NC, namely, William W. Brand (1756-1848) who is documented as born in 1756 in Edgecombe Co, NC.[3]

Moreover, in 1753, Peleg Rogers sold land to Benjamin Brand in Edgecombe Co, NC, which adds to this perplexing puzzle. In 1759, Benjamin sold this same land. Did he move to New Hanover? By 1761, Benjamin was again active in Edgecombe Co, NC. Is this the son of Thomas III of RI? If so, Benjamin was likely married three times.

Based on records, Edgecombe Benjamin could have been born as early as 1700 or as late as 1732. He likely died after 1790, when he was last documented in Edgecombe Co, NC.

The book Vital record of Rhode Island 1636-1850 contains many errors. It provides conflicting information regarding the marriage of Benjamin and Rebecca in addition to incorrect citations. It appears Rebecca Tanner and Rebecca Sweet might be the same person.

In 1742, a deed from Benjamin and Lucy Brand to Thomas and Sarah Brand establishes a connection between Thomas Brand III and his son, Benjamin, who married Lucy.[10]

In 1753, Lucy Brand purchased land and was referred to as a "widow, so called" in Westerly, RI.[11]

In 1759, again Lucy is documented as a land owner in Westerly, RI.[11]

Records for Benjamin Brand in RI

Between 1736-1759, before signing his LWT in 1762, Thomas Brand III (abt.1678-1766) gives land to all sons. Additionally, Thomas gives land to daughter Jane and son-in-law George Hall. Below, Benjamin purchases land from James. The same land was given to James by his father, Thomas. Later, this Benjamin appoints "trusty friend" Thomas Brand to be his POA. This speaks to the relationship. Numerous deeds for Westerly, RI, use language such as son, daughter, brother, sister, mother, and father. There were at least three Thomas Brands in Westerly in the 1740s, one being Thomas, the son of Tobias. Which Thomas was appointed POA?

Furthermore, these deeds appear to document Thomas' son Benjamin as married to Lucy in the early 1740s.

  • Note: The year isn't clear. It appears to be 2 Jun 17_6, whereas the best guess is 1736. The deed is believed to have been entered on 2 Jun 1736. It was signed and recorded on the same day, which is uncommon. It is on the same page as other deeds signed in 1724 and 1739, in Land Evidence Vol 3, 1717-1728. Also, in Jun 1736, Thomas Brand gave 81 acres to son James Brand. However, it is recorded in Land evidence Vol 4-6, 1725-1745. Notice that the same witnesses appear on both 1736 deeds.

Town Record - On 6 Jun 1736, Westerly, Washington Co, RI, Benjamin Brand was admitted as a freeman. Also, he was one of many chosen as Constable for the year. At the same meeting, James Brand was admitted as a freeman.[2]

Deed - On 4 Feb 1742/3, Westerly, Washington Co, RI, Benjamin Brand appoints trusty friend, Thomas Brand, to be his attorney to sale land bounded by Thomas Brand on the east, Pawcatuck River, John Lewis, David Lewis, Stephen Saunders, and land Benj Brand sold to Thomas Kimber. Deed - On 18 Mar 1742, Westerly, Washington Co, RI, Benjamin Brand and Lucy his wife, 15 acres to Thomas Brand and Sarah his wife. "Thomas and Sarah Brand have acquitted & discharged all their rights widows thirds dowry & demand to all ye other land, which I sd Benjamin Brand have deed of..." Witnesses David Lewis and David Hall. p386.[10]

  • This Benjamin gives land to Thomas and Sarah Brand, and Thomas and Sarah discharge their rights. What are the implications regarding their relationship? Words like 'appurtenances and privileges' are used in the text. Did Benjamin and Lucy give 15 acres to his father and presumed stepmother, Sarah? Perhaps an arrangement to allow his father use of the land Benjamin previously received from his father? Or was some other kind of inheritance involved?
  • Furthermore, in 1753, was Lucy truly a widow, or was she separated from her husband? Did her husband leave, or was he presumed dead?
  • On 27 Aug 1753, Westerly, Washington Co, RI, Thomas Clark to "Lucy Brand widow, so called", land bounded by the highway and river. Witnesses Joseph Clark Jr and Deborah Clark. p15.[11]
  • On 22 Feb 1759, Westerly, Washington Co, RI, Lucy Brand, yeoman, to Thomas Brambly, land bounded by the highway and river. Witnesses Benjamin Randal, justice and John Lewis Jr. p350.[11]

Deed - On 19 Sep 1743, Westerly, Washington Co, RI, Thomas Brand by virtue of Letter of Attorney dated Feb 1742 by Benjamin Brand, to Benjamin Weight of North Kingstown Practitioner of Physick, 180 acres bounded by Benjamin Brand, Thomas Brand, Stephen Saunders, Edward Lewis, and John Lewis. It is ye land which Benjamin Brand purchased of James Brand. Witnesses Silas Greenman and John Deake. p234.[15]

Deed - On 19 Sep 1743, Westerly, Washington Co, RI, Benja Weight of North Kingstown, Practitioner of Physick, to Thomas Brand, quit claim, 80 acres. Witnesses Silas Greenman and John Deake. p256.[15]

Deed - On 26 Mar 1744, a probate record for Thomas Brand dec'd identifies Judith as his widow. He's believed to be the son of Tobias. Captain Caleb Church, husband of Rebecca Brand-Church, was administrator for Thomas.

  • Was this the Thomas who held the POA for Benjamin? However, he passed away before the following quit claim from Benjamin Weight.

Deed - In Jun 1744, Westerly, Washington Co, RI, Benja Weight of North Kingstown, physician, to love, good will to my friend Thomas Brand of Westerly, quit claim, 80 acres, bounded by land which I have passed unto Benjamin Willbur. Witnesses Job Tripp, justice, and Abial Tripp. p167.[11]

Probate - On 18 Jan 1762, Westerly, Washington Co, RI, the LWT of Thomas Brand III (abt.1678-1766) was written. Son Benjamin Brand to receive five shillings. It was proven on 27 Oct 1766.

Brands in Edgecombe Co, NC and GA

We can first document this Benjamin Brand, presumed father of William W. Brand (aka William Warren Brand), in Edgecombe Co, NC. Assuming Benjamin was at least 21 years old when he purchased land in 1753, he was born before 1732. His theorized son, William Brand, was born on 23 May 1756 in Edgecombe Co, NC. Ultimately, William Brand ended up in Walton Co, GA, where he filed for pension benefits and provided information about his birth.[3][17]

Between 1753 and 1798, records existed for five Brands in Edgecombe Co, NC. Those were Benjamin Brand, William Brand, Thomas Brand, Christian Brand, and Joshua Brand. It's theorized that there were two Benjamin Brands in the area, a father and son. However, there are insufficient records, both in NC and GA, to support this theorized Benjamin Brand, Jr. Furthermore, no use of Senior or Junior is found in records. See explanation.

With the records available, it is unclear when Benjamin Brand (bef 1732 - aft 1790) of Edgecombe Co, NC, was born or when he died. Based on records, it appears he was still living in 1790. It's also feasible that Benjamin was a young man in his twenties when William Brand was born in 1756. Without more definitive documentation, we are left with speculation.

Children of Benjamin Brand of Edgecombe Co, NC

Documentation exists to support two or possibly three sons. Two sons, William Brand and Thomas Brand are documented in both NC and GA. Christian Brand is documented twice, among these Brands, in NC.

  3. Christian Brand (born bef 1763) might be a son of Benjamin Brand of NC.
  • Joshua Brand is possibly a son of Benjamin. Joshua served as a witness on 21 Feb 1794 for a deed of sale for William Brand of Edgecombe Co, NC. Therefore, Joshua was born before 1773-1780 (age 14-21 when he served as a witness). Reportedly, a witness in NC could be 14 years old. But one needed to be 21 years old to purchase land. Technically, Joshua could be William's son. In 1773, William was 17 years old. However, it's believed William didn't marry until after his service in Revolutionary War.
  • Benjamin Brand, Jr. is often theorized as a son, yet there is insufficient documentation to support his existence. See Research Notes on William Brand's profile.
  • John Brand is often theorized as a son who "moved west". In 1764, a John Bratcher Brand (full name documented in records) was living in Cumberland, NC. He was documented in Cumberland, Dobbs, Glasgow, and Greene Counties with land on the Black River. It appears he was rezoned into the other counties. He would have been born before 1743. It is unknown if he was related to any of these Brands. Based on age, it's unlikely he was a son of Benjamin of RI. Birth records indicate Benjamin was having children with Lucy through about 1744-45.

History of Gwinnett Co, GA

The Brands of Gwinnett County, almost without exception, as well as their kindred of many other names, here and in many other places, are descendants of William Brand, a N. C. soldier of the American Revolution. He was born May 23, 1756, in Edgecombe County, North Carolina, not far from Tarboro, the county seat. Family tradition has it that his father was Benjamin Brand, of Virginia, who settled in N. C. and married there before 1756, the name of his wife as yet being unknown. There is also an unverified tradition to the effect that "Grandsire" William Brand's grandfather, also named Benjamin Brand, came from Scotland or England to Virginia many years before the American Revolution; that he was educated at Boston to be an officer in the British Navy; and that he was noted as a penman, a rare accomplishment in his day.

Family History Passed Down

Brands of Edgecombe Co, NC, and Walton Co, GA: Presumed brothers William W. Brand and Thomas Brand moved from Edgecombe Co, NC, to GA.[3] Letters exchanged amongst cousins in the early 1900s may shed some light on this Brand family.

  • Letter #1 - by John Randolph Wilson (1850-1938) written in about 1916-1924, in Walton Co, GA.[19]
  • Letter #2 - by George W. Jacobs, II (1900-1990) written in 1930, in Washington, D.C. Part of his research involved correspondences with Levi C. Brand and interviews with John R. Wilson.[20]
  • Letter #3 - by Onas D. Brand (1920-2000) born in Forsyth Co, GA.

Excerpts from the letters above:

  • "According to the family tradition, as handed down by Isaiah C. Brand to his grandson, John R. Wilson, the founder of this particular branch of the Brand family in the country was Benjamin Brand, who is thought to have come from Scotland or England."[20]
  • "Benjamin Brand is said to have migrated to Virginia many years before the American Revolution."[20]
  • Benjamin Brand married a lady in VA with the last name Cashuel.[19][20] "They had three children."[19] "She was the mother of our great grand father William."[19] (William W. Brand 1756-1848)
    • "Cashuel Brand, (sometimes spelled or misspelled Caswell), fourth son of William Brand, was born in Edgecombe County, North Carolina, in 1793, as previously stated, and came with his father to Georgia before 1800."[20] Note: Cashuel Brand (b:1793) should not to be confused with Isaiah C. Brand (b:1808).
  • "Benjamin Brand, Sr., later removed to Edgecombe Co., N.C."[20]
  • "He (Benjamin) is said to have been educated at Boston to be an officer in the British Navy, and is reputed to have been a noted penman. No attempt has yet been made to verify from British sources his supposed connection with the Royal Navy."[20] This information was provided in Jacob's letter. However, Wilson's letter states Benjamin was a "midshipman", and does not mention Boston.[19] For reference, a midshipman is an officer of the lowest rank.
  • Onas D. Brand, wrote a letter stating, in part, "Knowing that William W. Brand was born in North Carolina and that his father was named Benjamin Brand; I assumed that Benjamin of Rhode Island was his father. There was always some doubt in my mind about this... Folklore tells us that Benjamin was a penman trained by the British Navy. The N.C. Benjamin was much in demand for witnessing legal papers... 1745 was the last record of this family in R.I. So, I thought they probably went to N.C., but no. Mrs. Marcia Paulsen of Buffalo, Minn. has records of this bunch of Brands who migrated westward in the upper tier of Northern states. She is a descendent of David Brand. So, back to the drawing board!"
  • In his letter, George W. Jacob speculates that Benjamin Brand might be somehow related to Captain Ellis Brand, who is well-known for his involvement in attempting to apprehend Blackbeard in 1718. He says, "Here's hoping I can find out some day! The coincidence of both having been in, or educated for the British Navy; both having lived in Virginia; and both having come to the eastern coast of North Carolina, one in pursuit of pirates, and the other to settle there, are too strong not to mean a connection of some kind between them, as I see it. Maybe I will even write to the British Admiralty Office some day and see if I can find out any more about these Brands."[20]

Based on variations from the stories passed down, it's unclear which Benjamin was the penman and midshipman. Was it William's father or grandfather?

Records for Benjamin Brand in Edgecombe Co, NC

Land - On 4 Jun 1753, Halifax Co, NC. Poley Rogers 400 acres to Benjamin Brand, both of Edgecombe Co, NC. Land on Town Creek of Edgecombe Co, NC.[21] In 1779, William Brand (1756-1848) bought land on Town Creek. This deed is the only connection to someone from Rhode Island. See Peleg Rogers Sr. (abt.1700-abt.1786). It appears Peleg Rogers was in Bertie Co, NC, by 1734.

Birth of son - On 23 May 1756, Edgecombe Co, NC, William Brand was born.[3]

Witness - On 6 May 1757, Edgecombe Co, NC, James Permenter to Richard Sessoms, both of Edgecombe Co, NC. Land for 4000 weight of good and merchantable pork, 200 acres on Little creek part of a grant to me 20 Apr 1745. Witnesses Benjamin Brand and Absolom Holleman. Recorded May 1757.[23]

Witness - On 13 Oct 1757, Edgecombe Co, NC, Jon Stephens of Edgecombe Co to William Hatcher of Edgecombe Co for 100 acres on the south side of Tosneot swamp at the mouth of a branch. Witnesses William Goodwynn, Benjamin Brand, and Moses Coleman. Recorded Feb 1758.[23]

    • It seems likely this is Benjamin Brand with Christian Brand. Christian witnessed a deed for William Brand on 3 Jan 1790, and Christian also served as a witness alongside William Brand and Benjamin Brand in 1781.
    • Another option, maybe Benjamin, is with an unidentified son living with him. In 1800, James (age 26-44, born 1756-1774) was enumerated in Pitt Co, which was very close to the Town Creek area of Edgecombe Co. Also, there was a Jesse who had a LWT in Edgecombe Co in 1828.
  • Thomas Brand - One male over 16, two females, three males under 16. This appears to be a younger family. Therefore, Thomas is a presumed brother of William Brand and not his father.
  • William Brand - One male over 16, two females, three Males under 16. On same page, Thomas Brand, Benjamin Brand, and Gail Bryant.

  • FTDNA Project for surname Brand. Currently, results for participants in the project are not within genealogical times.
    • I.e. The Time Tree for one subgroup, whereas the closest common ancestor was born 3000 bce. This is obviously too far back to be used for genealogy. Info as of 23:23, 14 September 2023 (UTC)
  • Therefore, more participants are needed. Y700 tests have the potential to provide the most impact.

Connections between two of Benjamin Brand's sons: Regarding Benjamin Brand of Edgecombe Co, NC. Thomas died in GA before 7 Jan 1811, when William Brand was appointed guardian of Mallackiah Brand, an orphan of Thomas Brand.[30]

Captain Ellis Brand: "Captain Brand" has been identified by numerous historians to be Captain Ellis Brand of Blackbeard fame. Captain Ellis Brand of the HMS Lyme was involved in events in about 1718-1719. Upon the conclusion of these events, "Brand sailed back to Virginia."[31][32] This documentation conflicts with rumors that this Benjamin Brand was Captain Brand. Benjamin Brand (allegedly b:1713 RI) was a 5-year-old child. Furthermore, the captain's first name was Ellis not Benjamin.
