Biography

Thomas Brand (3rd) was born about 1678 in Connecticut Colony. He signed a will on 18 Jan 1762. He died in 1766 in Westerly, Washington Co., RI (i.e., Kings County, Colony of Rhode Island and Providence Plantations). He had an estate probated on 27 Oct 1766.[1]

He was married to Elizabeth Babcock (daughter of Job Babcock Sr. and Jane Crandall) in 1699 in Westerly, Kings County, Colony of Rhode Island and Providence Plantations.[2][3] Elizabeth Babcock was born about 1681 in Westerly, Kings County, Colony of Rhode Island and Providence Plantations. She died about 1720 in Westerly, Kings County, Colony of Rhode Island and Providence Plantations.[citation needed]

Thomas Brand and Elizabeth Babcock had the following children:

  • Thomas Brand (4) — born about 1705
  • Isabel Brand-Rogers — born about 1706
  • James Brand — born about 1710
  • Benjamin Brand Sr. — born about 1713

  • Grandson John Millard, five shillings (Note: a deed indicates Thomas Brand Jr. was the father-in-law of Nelmn Millard. Did more than one Brand marry a Millard? Or is this for a great-grandson?)

In Mar 1766, David Lewis the executor of the Last Will & Testament of Thomas Brand being summoned by a ___ officer to appear before the council. Voted that Thomas Brand of Westerly, a son to Thomas deceased, to be administrator.[5]

Residence - In Jan 1704, "Inhabitants and yeomen of the Town of Westerly January 1704", Tobias Brand and Thomas Brand are among those listed.[6][7] Tobias was documented in the area in 1698.

Deed - On 31 Dec 1707, Westerly, Washington Co, RI, a deed from James Adams to Thomas Brand for 40 acres. Witnesses Nathan Boudish and Samuel Donison. Entered 2 Nov 1715.[2]

Deed - On 27 Jan 1708, Westerly, Washington Co, RI, James Adams deed. Bounded by James Lewis, William Hardy, and Thomas Brand. Signed James Adams. Witnesses Thomas Hiscox and Joseph Clark. Entered 22 Oct 1713 by John Babcock, Town Clerk.[2]

Deed - On 7 Sep 1708, Westerly, Washington Co, RI, a deed for Job Babcock, a blacksmith, "unto my daughter Elizabeth Babcock the wife of Thomas Brand, I have given her and her children 50 acres of land". Bounded by Edward Bliven and Job Babcock's own land. Witnesses Thomas Hiscox and Joseph Clark. Entered 15 May 1711 by John Babcock, town clerk.[2]

Deed - On 13 Mar 1710, Westerly, Washington Co, RI, record regarding laying out or making a highway beginning at a county road and bounded by Christopher Champlin, where Joseph Wordin formerly lived, Capt. John Babcock, following a new path by a bog and following the old way from sd bog to Thomas Brand, the line Blivens & T Brand & William Hardy, to a little swamp, around the corner of sd swamp, to the line between sd Brand and Hardy. Written it's understood that the road is to be 4 rows wide all the way and where William Hardy & Thomas Brand's lands join they are to be two rows wide. Signed John Mackcoon, Joseph Maxson, and John Hill. Entered 26 Aug 1712.[2]

Deed - On 3 Apr 1710, Westerly, RI, a deed from James Adams to Thomas Brand, both of Westerly. Bounded by Pawcatuck River, James Lewis, and William Hardy. Witnesses a Saunders and Zachariah Allen.[2]

Deed - On 4 Apr 1710, Westerly, Washington Co, RI, a record regarding some kind of difference and agreement involving property boundaries. William Hardy, Solm__r, and Thomas Brand, husbandman, both of Westerly. John Mumford of Newport surveyor. Entered 2 Jun 1710.[2]

Deed - On 12 Nov 1714, Westerly, Washington Co, RI, another deed addressing the gift of 50 acres from Job Babcock to his daughter Elizabeth Brand. States it "confirms" that "said Jobe Babcock and Thomas Brand of ye Town and Colony afore sd husband of ye afore sd Elizabeth Brand... jointly agree". Bounded by Daniel Brown. Signed Job Babcock and Thomas Brand. Witnesses Daniell Brown and Edward Bleven Junr. It appears this deed is addressing boundary lines and has Daniel Brown and Edward Blivens signing off as well. It was entered in 1715.[2]

Deed - On 3 Apr 1716, Westerly, Washington Co, RI, William Hardy & Parsillia his wife 40 acres to Stephen Saunders. Bounded by Thos Brand and James Lewis. Signed William Hardy and Parsillia Hardy. Witnesses John Hill and George Stillman. Entered 13 Feb 1716/7.[2]

Town Records - On 13 Feb 1716/7, Westerly, Washington Co, RI, recorded by the town clerk that Thomas Brand's brand (earmark and left buttocks) was "T B".[8]

Town Records - On 24 Sep 1718, Westerly, Washington Co, RI, Thomas Brand was admitted as a freeman.[8]

Deed - On 1 Sep 1727, Westerly, Washington Co, RI, a deed for John Lewis and Marcy his wife, mason, to David Lewis, part of tract my father gave to me, quit claim. Bounded by Thomas Brand, Stephen Saunders, and James Lewis. Witnesses John Enos and Elizabeth Johnson. p216.[9]

Town Council - On 30 Oct 1727, Westerly, Washington Co, RI, a council record for Thomas Brand for carrying Persillah Pierce out of town. p276.[10]

Deed - On 24 Sep 1731, Westerly, Washington Co, RI, a deed for Charles Ninegret, Chief Sachem of Narragansett, to Thomas Brand for 50 acres. Witnesses Samuel Mott and William Babcock. p333-334.[11]

Deed - On 6 Mar 1732, Westerly, Washington Co, RI, a deed for Charles Ninegret, Chief Sachem of ye Naragansetts, to Stanton York for 66 acres. Bounded by James Bleavin, heirs of James Bleavin dec'd, Thomas Brand, and John Enos. Witnesses Samll Mott and Danll Stanton.[3]

Town Meeting - On 6 Jun 1733, Westerly, Washington Co, RI, Thomas Brand, John Haloway, John Halloway, and James Halls were chosen as grand jurymen to attend Inferior Court to be held at South Kingstown the last Tuesday of June.[8]

Witness - On 13 Aug 1733, Westerly, Washington Co, RI, a deed for Charles Ninegrett, Chief Sachem of ye Naragansetts, to John Millard Late of Kingstown, a carpenter, for 132 acres. Bounded by John Johnson and Reuben Johnson. Witnesses Joseph Park and Thomas Brand.[3]

Witness - On 14 May 1734, Westerly, Washington Co, RI, a deed for Roger Elderton and Lydea his wife to Joshua Babcock, a physician, for 41 3/4 acres. Bounded by Stephen Babcock, Capt. John Babcock; being land said Elderton purchased of Capt. Christopher Champlin and Samuel Slack. Witnesses by Joshua Champlin, William Babcock, and Thomas Brand.[3]

Town Meeting - On 5 Jun 1734, Westerly, Washington Co, RI, Thomas Brand chosen as grand juryman and B__ Smith and Wm Champlin Junr chosen for Pettitt Jurymen to attend court to be held at Newport on the first Tuesday in September next.[8]

Town Meeting - On 3 Mar 1735/6, Westerly, Washington Co, RI, Thomas Brand chosen as grand juryman and Samuel Champlin and John Hill Junr chosen for Pettitt Jurymen to attend Superior Court to be held at Newport on the last Tuesday in March.[8]

Deed - On 9 Oct 1735, Westerly, Washington Co, RI, a deed for Stanton York and Jemima his wife, a cordwinder, to Edmund Pendleton Jr., a husbandman, for 20 acres. Bounded by Thomas Brand, John Enos, and James Bleavin. Witnesses John Enos and Ann Enos.[3]

Deed - In Jun 1736, Westerly, Washington Co, RI, a deed for Thomas Brand to son James Brand, 81 acres. Witnesses Thomas Babcock and Joseph Maxson.[12][3]

  • Note: The year isn't clear. It appears to be 2 Jun 17_6, whereas the best guess is 1736. The deed is believed to have been entered on 2 Jun 1736. It was signed and recorded on the same day, which is uncommon. It is on the same page as other deeds signed in 1724 and 1739, in Land Evidence Vol 3, 1717-1728. Also, in Jun 1736, Thomas Brand gave 81 acres to son James Brand. However, it is recorded in Land evidence Vol 4-6, 1725-1745. Notice that the same witnesses appear on both 1736 deeds.

Deed - On 25 Dec 1738, Westerly, Washington Co, RI, a deed from Thomas Brand to son Thomas Brand, Laborer, quit claim, 50 acres, it being all ye Land that was given to my wife Elizabeth & her heirs by her dec'd father Job Babcock 7 Sep 1708. Land bounded by John Enos, Edmund Pendleton Jr, heirs of John Bleavin, and James Bleavin. Witnesses Daniel McCoon and Wm Babcock.[12][3]

Town Records - On 4 Mar 1739/40, Westerly, Washington Co, RI, Thomas Brand was chosen grand juryman to attend Superior Court to be held at Newport the last Tuesday in March.[8]

Town Records - On 5 Jun 1739, Westerly, Washington Co, RI, Thomas Brand, John Witten, and Jerdediah Davis chosen as grand jurymen for Inferior Court to be held in South Kingstown the first Tuesday of August next.[8]

Town Records - On 4 Dec 1739, Westerly, Washington Co, RI, Thomas Brand chosen as grand juryman.[8]

Town Records - On 3 Jun 1740, Westerly, Washington Co, RI, Thomas Brand chosen as grand juryman to attend Inferior Court in South Kingstown the first Tuesday of August next.[8]

Town Records - On 7 Dec 1742, Westerly, Washington Co, RI, Thomas Brand, Nicholas Cottrill, and Jedadiah Davis chosen grand jurymen for Inferior Court to be held the third Tuesday in February next.[8]

Town Records - Entered on 24 Jan 1748/49, "A list of all ye freemen of Westerly Town from the first settlement thereof". This list includes Thomas Brand and Tobias Brand.[8]

Probate - In 1750, Westerly, Washington Co, RI, Edward Saunders administrator to the estate of his father Edward Saunders dec'd. Thomas Brand and W. Babcock are listed among those on the receipts list. It is unknown if this is for Thomas Brand Sr. or Jr.[14]

Residence - In 1750, both Thomas and Thomas Brand, Jr, are listed as Freemen in Rhode Island.[15]

Probate - In 1752, Westerly, Washington Co, RI, Lucina Lewis executrix to LWT of James Lewis dec'd late of Richmond. Numerous people named in receipts including Thomas Brand and Wm Babcock.[16]

Deed - On 1 Mar 1757, Westerly, Washington Co, RI, Thomas Brand to son John Brand, Laborer, 50 acres. Bounded by Daniel Peckham and Cornelius Stetson. Witnesses Samll Stanton, justice, and Peleg Saunders.[4] 

Deed - On 12 Oct 1757, Westerly, Washington Co, RI, Thomas Brand to son Robert Brand, laborer, 76 acres. Bounded by Stephen Saunders, David Lewis, and John Lewis. Watercourse Pawcatuck River. Witnesses Abigail Ball and Benj Hoxsie. Signed Thomas B. Brand (his mark).[4][17]

Deed - On 1 Mar 1759, Westerly, Washington Co, RI, George Hall, Robert Brand and John Brand stand firmly bound unto William Davis and Stephen Saunders (constable), overseers of the poor, 2,000 pounds. The condition of the obligation is such that George Hall and Jane his wife fully support and maintain at their own expense and cost Thomas Brand and Sarah Brand his wife, for all times of their natural lives. Witnesses Silas Greenman and Katherin Greenman.[4] 

Deed - On 9 Mar 1759, Thomas Brand to son-in-law George Hall and my daughter Jane Hall is wife... my wife Sarah during our Natural Lives... 50 acres... land I have given to my son John Brand and Stephen Saunders. Witnesses Silas Greenman, justice, and Katherin Greenman.[4] 

Deed - On 12 Mar 1759, Westerly, Washington Co, RI, Thomas Brand to son Robert Brand, 25 acres. Bounded by Halls, James Halls, and Stephen Saunders. Witnesses Mary Burdick and Simeon Burdick.[4]

Research Notes

Logistics: Washington County was created from Providence Plantations in 1729 as Kings County. It was renamed Washington County on October 29, 1781.[18] Records are found in Washington Co, RI. Hence, the use of Washington to identify the location.

LWT for a Thomas Brand in 1744: In theory, the 1744 probate record could be for one of three men named Thomas in the area.[19] By process of elimination, it's likely that the 1744 probate record is for Thomas, the son of Tobias.

  • The widow named in the probate record is Judith.
  • Caleb Church, husband or Rebecca Brand-Church (daughter of Tobias), was administrator.
  • We know Tobias Brand had a son named Thomas Brand. In 1738, "Thomas Brand son of Tobe" was admitted as a freeman.
  • In 1762, in the LWT of Thomas Brand III, he names son Thomas Brand.
  • In 1766, Thomas Brand, Jr. was appointed a replacement executor in his father, Thomas Brand III's estate. He was identified as the son of Thomas Brand. Therefore, neither Thomas III nor his son Thomas died in 1744.

Stephen Saunders: He was a neighbor of these Brands. He appears in numerous deeds for them as a result. Also, he was identified more than once in various deeds, "Stephen Saunders Overseer of the Poor".[4]

  • Jane Brand
    • 3 Jan 1764, Town Council voted regarding maintenance for a bastardly child between Samuel Bliven and Jane Brand. Rhode Island, U.S., Wills and Probate Records, 1582-1932; Washington Co Town Council and Probate Records, Vol 5-6, 1745-1787. p53, image 432 and also p56, image 433. This would not be Thomas III's daughter Jane, who was married to George Hall before 1759. This Jane is likely the daughter of Thomas Brand (abt.1705-aft.1766).

Page numbering issue on records: Several early record books for Westerly have both handwritten page numbers as well as stamped page numbers. This poses a problem when attempting to find cited pages, depending on which source you're using.
