Can I upload a 1925 German newspaper article?

From my grandfather I received documents and research about the Hägler family. Included was a 1925 newspaper article (copied, not original newspaper), in German, titled Die Hägler Eine oberpfälzische Bauernfamilie in 300 Jahren" "Von Pfarrer Thomas Rieß, Rothenstadt". The publication is Heimatblätter für den oberen Naabgau.

No copyright information and to my knowledge the publication no longer exists.

I would like to upload it and offer it to anyone who would like an overview of the families in the region.

Thanks for sending me the article, Klaus. There he is written with a normal s, which apparently makes a great difference to search engines.

I found some information about him, which I put into a profile (and added you as a profile manager wink). Since he passed away in 1944, you're safe to upload the article.

May I suggest to create a free space page from it, so you can link to it when using it as a source and put it into Category: Germany, Sources.

His DNB entry mentions his allowance. You might want to research that one's whereabouts a little deeper, since the article he wrote, says that he can provide a lot more data than he published there.

Hello Klaus,

I am not sure - as far a I know the copyright passes to the magazin publishing the article (I have been working in the publication team a local history magazine (Düsseldorfer Jahrbuch) and all our authors assign their rights to the articles to the publishing organisation) - so the 70 years would be over already. During the last twenty years we had several articles that showed copies of old newspapers and magazines as pictures, and there was never any discussion about getting the rights if they dated back to the 1920s or 1930s.

But to be on the sure side, you could transcribe the article (if it's not too long) and upload it as a citation with the correct source citation.

I doubt that you hand over the copyright to the publisher, in my opinion they usually only have the right to use it, sell it etc.

Typing the words instead of using the scan won't make a difference, because it's the creative effort that is protected by copyright.

The risk of heirs of the priest (may he even have been Catholic?) or the publisher sueing you for uploading the scan are very very low, I'd say.

PS: I posted a request at CompGen's Discourse (registration required). Maybe somebody can help us with the biographical data of the priest (and we could create a profile for him in return).

I've started the transcription but it is difficult for me as the script is in old German.  Length is about 3500 words.

The problem is that Wikitree warns against uploading copyrighted material. I don't want to break Wikitree policy. Can I offer the article in this forum and then direct anyone interested to access it in my cloud account?

Hi Klaus, have you uploaded it yet? I am a Hägler descendant (1600s) and my family belonged to Luhe Parish but before that Rothenstadt. I would like to read it. Thanks
