In the name of God, Amen, I, Moses Sherrell of County of Lincoln State of North Carolina, being frail of body but being sound of mind and memory on the 16th, day of February 1829 do make and publish this my last will and test in manner and form following.
- First, I leave and beq, to my wife Martha Sherrel. 2 negros Polly and Lean to her use in fee simple and to dispose of as she thinks proper and
- I also leave to my wife Martha the house wherein I now live on my lower tract of land to my Sd wife and other such buildings as she needs with every advantage of woods waters and other conveniences during her natural life subject to the exception hereafter mentioned I also allow my wife to make use of said tract of land in cultivation or otherwise as her necessity may require during her natural life so long as it does not exceed more than 1/2 of Sd tract
- I also leave to my wife Martha1 mare by the name of Lucy all my stock of cattle and hogs 1/2 of my sheep
- I also leave my wife 1 loom and all tacklings belonging to it and all my household and kitchen furniture and also all vessels and other articles necessary for the house and kitchen furniture that may not be considered as household or kitchen furniture
- I also leave to my wife and my son Strawbridge Sherrill my wagon gears tackles of every description farming utensils and tools of every description and all my property of every kind
- and also I leave my son Strawbridge the above mentioned tract of land subject to the exception above
- I also leave to my son Strawbridge 1 white colt.
- I also leave to my son Reuben the house he built in the lot about 1/2 acre if he needs that much with the privilege of water and the woods taken of of any part of my land as convenience may require and it is here to be understood if necessity affliction or any other cause unknown should require any further provision for my wife Martha my real estate is bound for it at the discretion of my executor.
- I also leave and beq unto my sons Jeptha and Isaac Sherrel in trust my upper tract of land for the use and benefit and support of my son Hartford Sherrel to be governed as the case may appear to them and the laws of the state in good policy during his natural life and then it is my will that his infant daughter Carolina have the Sd lands stated and in case Sd Caroline infant daughter should die without heirs to her body her full brother and sister or any one of them the Sd land to descend to my children. But it is here to understood that my Sd sons, Jeptha Sherrel, and Isaac Sherrel is to let my son Hartford Sherrel cultivate improve Sd land and to have the same and profits thereof to support himself and the family in case he will do so but if inattention or otherwise then the Sd trustees is at liberty to exercise their own will and their good policy and wisdom may direct for Sd Hartfords benefit.
- And I leave my son Obed Sherrel a bay horse
- And I leave my son Bennet Sherrel 1 gray horse.
- I leave my five sons(Sic) Reuben Elijah Obed Jeptha to them a feather bed and bedclothes
- I leave to my daughters Margaret Eliza Agnes Sally Elijah Obed Bennet and my son in law Adam Sherrel and my granddaughter Patsy Ward 5 negros to be sold by my excr and be equally divided.
-I leave to my son Jeptha Sherrel William Sherrel Thos Ward $2 each
It is my will that all debts notes and bonds and book accounts and any property not mentioned to be sold and collected for to pay my just debts then the balance is to be taken out of the proceeds of the 5 negros stated above
- And I also leave my son Hartford 1 bell colt
- I also leave my sons Jeptha and Isaac Sherrel to be my whole and sole exrs of this my last will and test revoking all other wills and test and confirming this to be my last will and test.
