On 7th April 1565 Patrick Hepburne of Wauchtoun made a charter in favour of Margaret Lundy, his spouse, in liferent, and Patrick Hepburne, his son in fee, of the lands of Brotherton, in implement of marriage contract, registered in Books of Council and Session 31 March 1565, between John, Lord Erskine, Walter Lundy of that ilk, Elizabeth Lundy, lady Gleneagles, and Isobel Haldane, her daughter, on the one part, and said Margaret Lundy and Patrick Hepburne, father of said Patrick, on the other part. Witnesses: John Logane, son and heir of Mr. John Logan of Couston, John Carkettle, yr., Robert Hepburne, brother of Patrick Hepburne of Kirklandhill [at Tynninghame], Patrick Hepburne, son of deceased John Hepburne of West Fortune, John Sandilands and Mr. James Arnot, notary.[1]
