Biography

Richard Lauder, younger of that Ilk, was his father's son and heir-apparent. Burke[1] erroneously gives this Richard's Christian name as Robert, and an incorrect marriage year. Young states that Richard Lauder was the "eldest son of Robert Lauder and Mariotta [sic] or Alison Cranstoun" and was the "successor to his father's estate of Lauder, [although there is no evidence of this - as he died v.p.] and was a Senator of the College of Justice by the title of Lord Lauder." He correctly states that Richard "married Mary MacDougal, daughter of the Laird of Mackairstone, in Teviotdale".[2][3]

There is a Warrant under the Signet charging the Sheriff of Berwick and his deputes to apprehend Gilbert Lauder of Quhitslaid, Richard Lauder, younger of that ilk, and William Lauder, brother of said Gilbert, who had been put to the horn for the slaughter of deceased George Wedderat, burgess of Lauder, but had fortified and were holding the house of Quhitslaid. Alexander, Lord Hume, is ordered to assist the sheriff. At Edinburgh. Signed by Queen Mary and King Henry. Fragment of Signet applied, dated 20th October 1565.[4]

Anderson writes: "Richard Lauder of Lauder is said to have been a Senator of the College of Justice by the title of Lord Lauder, and as his successor on the bench was appointed in 1575, he is supposed to have died before that year. His name, however, does not occur in Brunton & Haig's Historical Account of the Senators of the College of Justice, but, on the 9th July 1575, James Meldrum, younger, of Segie, was appointed a Lord Ordinary on the temporal side "in place of William [sic] Lauder of that Ilk", of whom no account is given."[5]

Robert Cairncross of Commislie and his spouse Barbara Home, are mentioned as cautioners for his sister's marriage contract to Richard Lauder of that Ilk (his second marriage) dated at Edinburgh on 21st June 1565. One of the witnesses was Nicol Cairncorse.[6]

Shortly before his death, a Precept of Confirmation appears of a charter by Robert Lawder of that Ilk in respect of of Richard Lawder his son, who is tenant of said lands, with the express consent of Alison Cranstoun, Robert's wife, who is joint conjunct feu-holder of the said lands, to Margaret Cairncross, sister of Robert Cairncross of Commislie, of Robert Lauder of that Ilk's lands at Sunderland and Sunderlandhall in Selkirkshire, with pertinents; and lands of Cauldscheilis and Wynnis, Over Woodhead, and Boggs in Lauderdale. Confirmed at Seton, 1st March 1567.[7] It is unclear what this charter is for, but doubtless it is the normal security for Richard's second wife, for her lifetime. We see all these properties in subsequent future Lauder of that Ilk transactions.

Richard married twice. The first marriage contract, drawn up between all the parties (parents and bride and groom) was signed and dated at East Mains, Lauder, on 4th May 1556.[8] The second marriage contract is also in the archives. Witnesses were Gilbert Lauder of Balbardies, William Home, Nicol Cairncross, and William Paterson, notary, "with diverse others".[9]

He had three sons by his first wife. No known issue to his brief second wife.

Richard was killed in a feud: In the archives is a Precept for a Remission, dated 5th January 1573/4 at Haddingtoun, to David Hume, lawful son of the deceased John Hume of Blackadder, Robert Hume, also his son, Patrick Hume in Garvetgrange [Garvaldgrange], Thomas Syth in Blackadder, James Johnstoun in Fischeweik [Fishwick, near Berwick] and Thomas Broun in Hiltoun, "for art and part in the slaughter of Richard Lauder, younger of that Ilk, in June 1567"[10], a month before his father died.
