Biography

Peter Benham was born in Hamilton County, Ohio on 18 Aug 1797 to Richard and Lydia Benham. At the age of 21 he married Catherine Beck on Christmas day 1817.[1][2]

Peter and Catherine had at least 8 children:[3][4]

Peter and Catharine have not yet been located in the 1840 Census. In 1850, they were recorded living in Mad River, Montgomery, Ohio with their three youngest children.[3] By 1860, they were living in Beaver Creek, Greene, Ohio; only son Samuel remained at home, but there was a 10-year-old Catharine Rock living with the family.[4] Her relationship is not stated.

Peter's wife, Catharine Beck died on 21 Dec 1864,[16] and on 13 Jan1867, Peter married, as his second wife, Catherine Nave, the daughter of John Nave.[12] Catherine was 30 years younger than him. In 1870, they were living in Beaver Creek.[17] There do not appear to have been any children from this union. They were still living in Beaver Creek in 1880.[18]

Peter died on 19 Dec 1883 in Beavercreek, Greene, Ohio at the age of 86, leaving a will that named each of his eight surviving children and his "kind and loving wife Catharine."

Will of Peter Benham[19]

In the name of God whom I revere as the giver of all my mercies and whom I love as my Savior. I, Peter Benham of the County of Greene and State of Ohio do make and publish this my last Will and Testament. I will and devise first that after my death my personal property such as shall not be hereinafter named shall be sold and my debts paid. 2nd I will & bequeath to my kind and loving wife Catharine one cow and all the properly she brought to my house when we were married together with what she may have purchased with her money or made since. 3rd I will and bequeath also to my kind and loving wife Catharine the following described Real Estate, one tract of land described in Deed of Conveyance by Peter Prugh & wife August 5th 1851 to me containing twenty acres more of less (rec. in Book B. 12 page 457) of Green less rec. Also one tract of land conveyed by Deed by George Huston & wife to me March 12th 1856 containing three acres (recorded in Book 34 page 3960 Green Co. Rec.) Also one tract of land conveyed to me by Harmon Recks & wife August 15th 1858 containing 1/4 one fourth of one acre (rec in Book [illegible] 37 page 80) Green Co. Rec. The three several tracts of land as described in the Deeds before mentioned making [illegible] twenty three & one fourth acres (23 1/4) together with all the appurtenances belonging there to have and to hold for her benefit during the time of her life. 4th I will and devise that my executor shall after paying my debts equally divide the money that shall remain from the proceeds of sale of my personal property together with such money as I shall died possessed of and pay to my children hereafter named equally.

My daughter Mary J. Johns having received of me already more than I expect my other children will relieve in the above distribution I do not bequeath her anything in this division of my estate. 5th I will and devise that after the death of my kind and loving wife Catharine my real estate shall be sold and the proceeds therefrom be divided equally among my children that shall then be living with this exception. Should my daughter Mary J. Johns and her husband Joseph Johns be living- I will and devise that my executors shall hold in trust her share and pay to her annually the interest of the same until the death of her husband. After his death I will & devise that my daughter Mary J. Johns shall come in full possession of her share. Should my daughter May J. Johns die before her husband Joseph Johns, I will and devise that her share be divided equally to my children that shall be then living. 6th I will and direct that my executor hereinafter appointed have full power without an order from Court to sell and convey my real estate as fully as if I did the same myself. I do nominate and appoint John W. Haynes of the County of Greene and State of Ohio Executor of this my last will and testament. In testament whereof I do revoke all former wills by me made and herein to set my hand and seal this the 10th day of November A. D. 1876.
