Biography

Benjamin was born about 1755-1765.

He was the son of John Barbee. [1]

He served in the United States Revolutionary War, and the state of North Carolina, Hillsborough District auditors office paid him 6 pounds 8 shillings on 13 Feb 1782. [2]

Court records in February 1783 in Orange County, North Carolina show that Rebecca Kidd accused Benjamin of being the father of her child. The name, sex or age of the child were not mentioned. Then in August 1808 there was another case of Ruth Roberts vs. Benjamin Barbee, that involved payment for support of her child. [1]

He married Phoebe. [3] Her last name is unknown, but was possibly Stovall. Benjamin Stovall, who lived nearby, named his daughter Phoebe in his will in 1802. The will was witnessed by Benjamin Barbee. [1] They had at least six children together: [1]

Benjamin died between 23 Dec 1825 when he wrote his will, and November 1826 when it was proved in Orange County, North Carolina.

Will

Benjamin's will dated 23 Dec 1825 was proved in Orange County, North Carolina in the November term, 1826. It names his wife Pheby, children Gabriel, Jemima, Rainy, Polly, Betsey and Gray (likely deceased, because it mentions his heirs), and grandson Francis Barbee, son of Gabriel. [3]

"In the name of God Amen, I BENJAMIN BARBEE of Orange County in the State of North Carolina being of sound & perfect mind & memory thanks be to God calling to mind the mortality of my body & knowing that it is appointed for all men to die do make and ordain this my last will and testament in manner & form that is to say. First I give and bequeath unto PHEBY my dearly beloved wife the one third of my land and likewise a negro girl named Silvia during her natural life. Item. It is my wish & desire that the residue of my land after my wife takes her third thereof will be sold by my executors agreeable to law as also all my stock of horses cattle & hogs also my household & kitchen furniture also all my farming utinsels and my waggon and my slave Peter to be sold agreeable to law & the whole amount of the sale to be equally divided between my wife and my children that is to say, my son GABRIEL my daughters JEMIMA, RAINY and POLLY for their children only. Item. I leave to my daughter BETSEY five dollars . Item. Should my son GABRIEL depart this life previous to the death of his wife the amount of what might come to him from the sale of the property above mentioned to go to his son Francis who I raised also my grandson FRANCIS BARBEE son of GABRIEL BARBEE is to have a equal part of the amount of the land . Item. On the death of my wife PHEBE her part of the land to be sold & equally divided between my son GABRIEL & the children of my three daughters JEMIMA, RAINEY & POLLY. NB I leave my son GRAY heirs 50 cents. I hereby make and ordain by worthy friend GABRIEL BARBEE & WILLIAM COOKE (last name looks to be inserted and in different writing - JEA) my true and lawful executors of this my last will and testament November (scratched out) December 23 1825 - Signed sealed published pronounced & declared by the sd BENJAMIN BARBEE as his last will and testament. He died sometime when his will was written on 23 Dec 1825 and Nov 1826 when in was proved. He was a resident of Orange County, North Carolina when he wrote his will, so he likely died there.

  • Based on his age of 26-44 in 1800 and over 45 in 1810, he was likely born between 1755-1765. His father appears in records in North Carolina in 1759, so Benjamin was likely born in North Carolina, not Virgiinia.
  • This Benjamin Barbee was previously connected to John Barbee (abt.1735-1799) as his father, but he was not named in this John Barbee's will, although he was alive at the time.
  • Benjamin was previously connected to Rebecca Kidd as his wife, but while he may have fathered a child with her, there is no evidence they were ever married.
  • The attached son, Mathew Barbee (1781-1835), isn't named in his will. Is there any evidence they were father and son? Should they be disconnected? The court record where Rebecca Kidd accused Benjamin of being the father of her child does not name the child

Barbee-1995 and Barbee-689 appear to represent the same person because: Vital stats are the same. Barbee-1995 is unsourced. They appear to be duplicates.
Same name and similar birth and death info, but this Benjamin Barbee didn’t have a son named Thomas and the other one does. If these profiles are merged then Thomas should be disconnected as a son (there is no source for the relationship anyway). I suspect Thomas was confused with a different Thomas Barbee who was the son of a different Benjamin Barbee. See the research notes on Thomas’ profile.

Barbee-1030 and Barbee-689 are not ready to be merged because: Same name, same will. Different wives, although he could have been married twice. Very different birth years needs to be resolved.. Neither is sourced. Barbee-689 is connected to the wrong parents and needs to be disconnected. Father of Barbee-1030 appears correct, based on deeds, and wife was named in will.

Barbee-1030 and Barbee-689 appear to represent the same person because: Same name, county of residence, death and will, so clearly a dupliate.

Barbee-1030 has the correct father and wife. See research notes in Barbee-689 explaining why his parents and wife are incorrect. Birth was between 1755-1765, so 1760 is a good estimate. He was between 26-44 years old in 1800, so was not born in 1741.

There may a mix-up on this profile. Please check the birth and death data for Benjamin Barbee. I believe you have mixed up two different men. One Benjamin Barbee was born 1759 Culpeper Co VA married Mary Holloway and died 1813 in Butler Co Ohio while the other Benjamin Barbee born 1760, lived in Orange Co NC where he died 1825 leaving a will naming his wife Phoebe.
