William Waller enlisted in the United States Army on July 29, 1776, for a three-year term. At that time he was living between Shepherdstown and Harper's Ferry in Berkeley Co., Virginia. He served his full term and was honorably discharged July 30, 1779, near Stoneypoint Fort by Brig. Gen. William Woodford. He was in a company under Captain William Brady and served in the rifle regiment commanded by Colonel Moses Rawlins of the Virginia Line. Captain Brady made him a corporal and he served in that position during his enlistment.

In October 1781 he was drafted for three months in the Virginia Militia in Captain McCormick's Company in the regiment commanded by Colonel Morgan of Shepherdstown. He served until October 14, 1781, the Sunday before the surrender of Cornwallis at Yorktown, when he was honorably discharged because of illness.

Guernsey Co., Ohio Probate Court Will Book Last Will and Testament of William Waller, Sr. Written 1832 March 8; recorded 1833 March 25

I William Waller Sr. of the County of Guernsey in the state of Ohio do make and publish this my last will and testament in manner and form following that is to say:

First. It is my will that my funeral expenses and all my just debts be fully paid.

Second. I give devise and bequeath to my beloved wife Sarah Waller in lieu of her dower the plantation on which we now reside situate in Westland Township Guernsey County, containing about one hundred acres during her natural life, and all the livestock, horses, cattle, sheep, hogs and by me now owned, also all the household and kitchen furniture and other items not particularly named and otherwise disposed of in this will during her natural life as aforesaid, and that at the death of my said wife all the property hereby devised or bequeathed to her as aforesaid or as much thereof as may remain unexpended to my children in the manner herein after specified:

Third. I give and devise to my daughter Phoebe the black colt with her bed and bedding, beureaugh and all with one hundred dollars after my wife's decease.

Fourth. I give and devise to my daughter Catharine Burt one hundred dollars after my said wife decease besides what she has received.

Fifth. I give and devise to my daughter Leanner Lemon one hundred dollars after my said wifes decease besides what she has received.

Sixth. I give and devise to the children and heirs of my daughter Mary Sovorins deceased the sum of twenty dollars after my said wife's decease to be divided amonst them share and share alike.

Seventh. It is my will that after the above bequests are satisfied the remainder of my estate shall be divided among my five sons and three daughters namely Samuel, John, William, Joseph, Elisha, Catherine, Leanner and Phebe share and share alike. And lastly I hereby constitute and appoint Samuel Waller and William Leamon to be the executors of this my last will and testiment, revoking and annulling all former wills by me made and ratifying and confirming this and no other to be my last will and testament - in testamony whereof I have hereunto set my hand and seal this eighth day of March 1832.

Court of Common Pleas at March term 1833. The forgoing will of William Waller saw being brought into court, David Coulter one of the subscribing witnesses then, being called came into court, and being duly sworn in open court deposath and saith that he saw the testator subscribe said will, that witness subscribed said will as a witness in presence of the said testator that the said testator when he subscribed said will was of sound mind and memory of full age and not under any restraint. At the same time and place came Samuel Griffen the other subscribing witness to said will and being duly sworn in open court, deposeth and saith that he saw the testator subscribe said will, that witness subscribed said will as a witness in the presence of the said testator, that the said testator when he subscribed said will was of sound mind and memory of full age and not under any restraint.

I hereby certify that this forgoing testimony was taken in open court on the twenty fifth day of March A.D. eighteen hundred and thirty three and was by the court ordered to be recorded with the will.
