Biography

William was the son of Devereux Gilliam and Edith Ellis. He died before 1827 in Alabama even though his estate was settled in Georgia.

He married Jean Smith the daughter of William Smith, about 1791. Their daughter Ann "Nancy" married Mark Smith, a grandson of William Smith. Mark served as the administrator of William Gilliam's estate in 1827 in Oglethorpe.

It has been said that this William Gilliam was the father of William Harris Gilliam of Georgia who married Lucinda Fambrough; however, with Mark Smith serving as administrator it seems logical that this William is the William Gilliam whose daughter married Mark Smith.

He should not be confused with William Gilliam who married Fanny Walton on 29 May 1807 in Lincoln, GA. He too died in Alabama. His land was sold by Robert Walton who married William's sister Nancy and who was a near relative of William's wife Fanny Walton. The Acts of the legislature of the Alabama Territory. authorized the sale of William's land: "An act to authorize the administrators of William Gillam, deceased, to sell real estate." 12 Feb 1818.

Research

Caution should be taken when researching the William Gilliams of early Georgia as there were several:

  • William Gilliam of Albemarle County, VA who married Elizabeth Ellis. William left an estate in Wilkes County, GA in 1798.
  • William Gilliam who married Fanny Walton on 28 May 1807 in Lincoln County, GA. This William died in the Alabama Territory in 1826, in that part that became the Mississippi Territory per estate papers administered by his widow and Robert Walton in Madison County, AL
  • William Gilliam who married Ephiah Ford on 8 Dec 1807 in Hancock County, GA. Little is known about this William.
  • William Gilliam who married Mason Tarver, the widow of Robert Tarver, on 9 Aug 1809 in Wilkes County, GA. William Gilliam may have died before 1819 when Richard Tarver makes his will remembering sister Gilliam and makes provision for the education of John Gilliam.
  • William Gilliam, son of Burrell Gilliam of Northampton County, NC. Per administration papers of Adams and Burrell Gilliam, 1815, Northampton County granted Power of Attorney to son-in-law, Elias Hodges. Power of Attorney stated that both William Gilliam and Elias Hodges are of Jefferson County, GA.
  • William Gilliam who married Miss Harris the daughter of Edward Harris who left an estate about 1826 in Greene County, GA mentioning son Gilliam Harris. William Gilliam and Miss Harris married before 1818. This William is the father of William Harris Gilliam who married Lucinda Fambrough per deed: Harris Heirs to William H Gilliam dated 22 Oct 1847 in Greene County. Amy, Sarah & Polly Harris gave land in Greene and Oglethorpe Counties, GA to William Harris Gilliam. They had inherited this land from their father, Edward Harris. Living on an adjacent tract was their brother, Gilliam Harris.
  • William Gilliam, son of Devereaux Gilliam and Edith Ellis, married Jean Smith about 1791. She was the daughter of William Smith who left a will dated 1815 in Patrick County, VA mentioning daughter Jean Gilliam and grandchildren Nancy E Gilliam and Susanna Gilliam. This William died before December 1826 in Alabama per probate records in Oglethorpe County, GA which state William was "late of Alabama." His administrator was son-in-law Mark Smith. (This William Gilliam is the nephew of the William Gilliam of Albemarle County, VA above.)

Both of the Williams that died in Alabama both died about 1826, making it difficult not to co-mingled their lines. Fortunately, both left estates one in Madison County, AL and, the other, in Oglethorpe County, GA.

In the 1827 Land Lottery, "the orphans [plural] of William Gillum, decd" received one draw of land: Section 3, District 5, Lot 44. Since two William Gilliams died about 1826 it is difficult to determine who was awarded the Lottery Land.

Greg: Thank you for your wonderful and careful research. When I get home, where my records are, I will look for the source data for my information. When the Georgia archives were open (are they again?) I did see the plat that said William Gilliam's orphans but only one name was listed on the plat: William Harris Gilliam. It is twisting the long arm of coincidence too far to suggest that there were 2 William Gilliams who died in Alabama and had children entitled to the Ga Lottery 1827 orphan's lot.

Here's a solution. Let's say for argument sake the father of your William Harris Gilliam is the one that received the 1827 Land Lottery and another William Gilliam whose Will is administered by Mark Smith died in Alabama. We know this William died in Alabama per the estate records administered by Mark Smith.

How do we know the father of William Harris Gilliam died in Alabama? Is it from the estate records? If we untie the William Gilliams, then we only need one dying in Alabama.

I would love to see William Harris Gilliam on the land awarded in the Lottery.

William Harris Gilliam was the son of William Gilliam who died in Alabama because he had an orphan;s lot in the 1827 Georgia land lottery where he won a tract in Troup County per the Georgia records. William Harris Gilliam and wife Lucinda were living on that tract on the census of 1830 (from memory, could have been 1840). I will check when I have my records available. I have long suspected nancy Gillum Smith, wife of Mark Smoth the executor was his daughter. Where did you get the information on William's parents and daughters?

William Smith is associated with Devereaux Gilliam in Patrick County, VA (the father of William Gilliam.) William Smith's Will dated 1815 in Patrick County, VA mentions "beloved daughter" Jean Gilliam and grandchildren Nancy Gilliam and Susanna Gilliam. Nancy and Susanna share from William Smith's Will a "child's" portion, though they were grandchildren. On 29 Nov 1814 in Oglethorpe, GA, Nancy Gilliam married Mark Smith, the son of Isham Smith, the son of William Smith. Isham is mentioned in the Will of William Smith. As son-in-law, Mark Smith administers the estate of William Gilliam. On 26 Dec 1826, Oglethorpe County, GA Mark Smith applies for letters of Administration on the estate of William Gillum, late of the state of Alabama, dec'd.
