I think the best solution perhaps would be to contact the profile manager. If no response, mail info@wikitree.com and tell them why the picture can't be used.

I sent a fairly apologetic private message to the manager and then put the pic up for deletion by removing the profile from the pic and the pic from the profile.

Checked the web first, and it doesn't appear anywhere under a creative commons licence. Comes up in Google on a Geni profile, where it seems to have been removed already. And on a bunch of private family trees. Where they do aything they like.
