Will of Thomas Hardwick, Sr.

 

In the name of God, Amen--I, Thomas Hardwick, Sr. of Adair county and state of Kentucky, being weak in body but of sound and disposing mind and memory do constitute this my last will and testament in manner and form following to wit:

Imprimis I do bequeth to my beloved wife, Elizabeth Hardwick, a negro woman named Dinah, and a negro girl named Sally, and the plantation whereon I now live and as much of the woodland adjoining as will be necessary for said plantation, and two cows and calves, and two horse creatures to wit: _?_ and Lass' youngest filly, and one third of the plantations tools. One pot, one kettle, one skillet, and the coffee mill, two beds and their furniture, two pewter dishes, two bowls, one half dozen knives & forkes, and two bedsteads. It is my will that my said wife shall have use of the before mentioned property during her life if she continues a widow, but if she should marry it is my will that the part I have left here may return into my estate to go in the manner I leave the balance of my estate.

It is my will and desire that my son, John Hardwick, is to have one fourth part of the land I live on at the lower end of it. and he is to have one fourth at the upper end which is to convey to his brother, William Hardwick, as soon as the said William has paid the debt he owes me and the other debts he is owing so that there were will be no danger of it being sold for his debts.

It is my further will and desire that if my son, William, should fail in paying the before mentioned debt that my sons, John, George, and Philip, may settle with the heirs of their brother, William, for the debt he owes me and pay them the balance for the land, or may convey, after deducting the said debt he owes, to the heirs of my son, William, or keep it and divide it among themselves after paying them the balance.

It is further my will that my son, George, is to have one fourth of the land I live on to lay at the upper side of the land I have left to my son, John. It is to be laid off so as not to take the house nor the cleared ground about the house.

And it is my will and desire that my son, Philip, is to have the balance of the land where I live at his Mother's death or marriage or as much as he wants to make use of before. It is my will that my son, Thomas, is to have one hundred and twenty acres of land that was deeded to me by John Moore and that he now calls his.

It is my will that my Executors do pay to my two daughters: Mahaly and Mariah, thirty dollars apiece and its further my will that my sons, George and Philip, are to have sixty dollars apiece which is to be laid out in schooling of them.

It is my will and desire that the balance of my estate be equally divided among all my children after William Jones pays up thirty pounds., Thomas Loft pays thirty pounds, William Bricken Jr. pays thirty pounds, William Bricken, Sr. pays twenty seven pound ten shillings, and James Sanders pays six pounds.

It is further my will that my Executors shall sell at two year credit all my estate that is not left to my wife and children heretofore.

It is my will that my wearing clothers are not to be shared or sold.

I do hereby constitute nominate and appoint John Grundy, Bard Hayden, and my loving son. John Hardwick, my Executors to this my last will and testament. I do by these presents revoke and make void all wills heretofore made and I do constitute this my only lawful will as witness my hand and seal this 28th day of February 1807. Signed: Thomas Hardwick
