I, John Rice, In the name of God Amen do make this my last will and testament first I recommend that my body after death be deemthy burice. Secondly, after all my just debts are paid, I give to my beloved wife, Elizabeth Rice, for and during the term of her natural life the plantation and trust of land where I now live. Also with the same limitation two negros by the names of Cnpy and Desey also All the house, cattle,/ hogs plantation.?nols Te after her death as of follows deem pry to Mary Davis, and the lawful spree of her body forever. and Deay to my granddaughter Mercy Elizabeth Phillips, daughter of Katherine Phillips and to the lawful ipew of her body. Tharcly to Jane Davis wife of George David and the lawful ipew of their bodies forever, I give after the death of my said wife, the land on which I now live and all young caves there to reporrce to contain in 4the whole five ha area acres lying on the West bank swamp of catfish. also, the following negros Mary Dolly Prince and Will. Fourth, to my daughter Katherine Phillips wife of Zachariah L. Phillips and the lawful spree of her body forever, a Tract of land called the River Swamp. Street lying in Mearau District continuing four hundred and twelve acres also the following negro wench by the name of Susan, Bob, Caleb and Sam. To my daughter Mercy Davis, wife of Abyah Davis and to the lawful spree of her body forever, the following negros Sally, Isaac, Ebby, Peter and ? Harry. Seventhy, as this is my deliberate will I trust there will be no furtur Collection I sure thee that my Executors should equally ..... the same amoung the heirs above mentioned that is my children share and share alike. Lastly, I nominate constitute and appoint George Davis and my friend Eli B Wheler Executors of this my last will and testament. Watnip my hence and soul this 20th day of Sept. A.D. 1836. Some conflation is happening, as the Hopkins children aren't in the will it doth appear.

I john Rice in the name of God Amen do make this my last will and Testament.  First I recommend that my body after death be decently buried.  Secondly after all my just debts are paid I give to my beloved wife Elizabeth Rice for and during the term of her natural life the tract of land where I now live also with the same limitation two negros by the two names of Lenpy[?] and Desay all the horses cattle hogs plantation tools till after her death as follows ten pig[s] to Mary Davis and the lawful ishue [issue] of her body forever and Desay to my granddaughter Mary Elizabeth Phillips daughter of Katharine Phillips to the lawful issue of her body.  Thirdly to Jane Davis wife of George Davis and the lawful issues of their bodies forever I give after the death of my said wife the land on which I now live and all adjoining lands thereto supposed to contain in the whole four hundred acres lying on the Out Back Swamp of Catfish also the following negros Mary Dolly Bruce and Will.  Fourthly to my daughter Katharine Phillips wife of Zackariah L Phillips and the lawful issue of her body forever a tract of land called the River Savanah tract lying in Marion District containing five hundred and twelve acres also the following negros a wench by the name of Susan, Bob Caleb and Sam.  To my daughter Mary Davis wife of Alijah Davis and to the lawful issue of her body the following negros Sally Irene Ebby Peter and Harry.  Fifthly as this is my deliberate will I trust there will be no future controversy or dispute concerning the same.  Seventhly There is a debt due me by H Davis of Alabama when collected I desire then that my executor should equally divide the same among the heirs above mentioned that is my children share and share alike.  Lastly I nominate constitute and appoint George Davis and my friend Earl B Wheler executors of this my last will and testament witness my hand and seal this 26th day of Sept A D 1936 in the presence of H G Wall James Wall Washington Wall

NOTEtwo things about this transcription.

(1)  The word "issue," meaning those born of a particular woman.  In this document it is spelled using a letter (character) which is no longer used in modern English.  It was called a "swash" and here was used to represent the "sh" sound. 

(2)  I could find no punctuation in the document, so only supplied the most necessary periods.  If you would like, I can redo the transcription to include some very necessary commas! 

Lastly, I will mention there were places where names, et al., were a bit ambiguous, so please feel free to make corrections to my transcription!smiley
