If P F Peterson and Y Sokolov weren't legally married does he need a separate profile?

Yes.  Each person has their own individual profile, whether linked to a married spouse or not.

If they were not legally married, they can both be parents of any children, but they should not have a marriage record on wikitree. 

Help Page for Marriage states they should have a record IF married and can be deleted if they were not married
