Land rec'd as gift* 1695 Benjamin (of Thos Sr) Dunton Sr. received land as a gift in 1695 at tract N58, Bridgetown, N'hamp Co, VA. It was in this year that Thomas Dunton made a composite deed of gift, to take effect upon his death, for an equal division of the 600 acres among his five sons: Thomas, William, John, Benjamin and Joseph. In the document he made reference to the division lines which he had discussed with the sons, but unfortunately those lines were not in the deed so the exact division is uncertain except that the home part was to go his son Thomas. Three of the portions, except for a small part which went out of the family, were soon aborbed by the other two.

Court - namd in ejec* January 1722/23 Benjamin (of Thos Sr) Dunton Sr. was named in an ejectment suit in January 1722/23 at Northampton Co, VA. Jeremiah Hopewell (fictious name) complains in an ejectment suit against Richard Carvey. The Plf leased from Robert Widgeon (Wiggen) two messuages (dwelling houses), four tobacco houses, 200 ac land, 200 ac pasture, 300 ac marsh and 400 ac woodland with all appurtenances for a term of 5 years in June 1721. The said Jeremiah took possession, but within a few weeks Richard Carvey (brother-in-law of the lessor) ejected the said Jeremiah with force. Jury found for the Plf. Other documents included show that Robert Wiggen (Widgeon) (wp 15 May 1677) bequeathed his dividend of 300 ac of land to his 3 children Robert, Mary and Margaret to be equally divided with the surviving child to have the entire parcel. It was not to be sold or otherwise disposed of. The report of the jury continues that by the consent of Robert Wiggens, Richard Carvey and Mary his wife and Benjamin Dunton and Margaret his wife, Edmond Scarbough, formerly Surveyor of the County, divided the 300 ac between the said Robert, Richard & Benjamin as by plat in 1702. The report also found that the widow, Mary died about 14 or 15 years ago (i.e. about 1708). Margaret the wife of Benjamin Dunton died in the lifetime of her mother and that Mary the wife of Richard Carvey died on 9 Jan 1721. The lessor Robert is the only surviving child of the Testator. Another document shows a long list of fees and costs against the Dft Richard Carvey levied by the Court.

Will* 9 October 1732 He made a will on 9 October 1732 at Northampton Co, VA. In his will Benjamin Dunton gave to my wife Mary 20s. To son Joseph. To son Joseph. To my grandson William Waterfield. To grandaughter Frances Waterfield. To grandson Waterfield Dunton. To granddaughter Sina Dunton. To granddaughter Elisha Dunton. To my son Levin my planation I now live on. Residual legatees my wife, my sons Joseph, Jacob and Levin and my daughter Santica. Wife and son Joseph extrs. Witt: Jonathan Stott, David Bell & Rickards 'X' Dunton.

Death* before 13 March 1743 Benjamin died before 13 March 1743 at Northampton Co, VA. It was on this date that his will was probated..

The last name of Benjamin is misspelled. It should be Dunton.................not Dutton. There are three Benjamins listed as children of Thomas Dunton. Two of them show the same wife and children; so need to be merged. The third Benjamin does not fit in the family.
