Distribution of Peter's property

Peter Reitz died intestate, but according to an agreement with his sons to distribute his property, those sons petitioned the Juniata County Court to partition his land. In that filing, Peter's children by his two wives are named.

Petition for Writ of Partition:  To the honorable the judges of the Orphans Court of Juniata County: The petition of Beneville and Tobias Reitz, sons of Peter Reitz, late of Monroe township in said county, doth respectfully represent:

That the said Peter Reitz died about the 21st day of June A. D. 1867, intestate, seized in his desmesne, as of and in a certain tract of land situate in the township of Monroe in Juniata County, and in the township of West Perry in Snyder County, adjoining land of Christian and Michael Shellenberger, Christian S. Gable [sic], John Shirk and Elias Landis and others, containing one hundred acres more or less with the appurtenances, and leaving to survive him, a widow, Sarah Reitz, and ten children living, viz.: (1) Elizabeth, wife of Adam Kreilick, residing in Ohio, p. o. Fremont, Sandusky County. (2) Mary, wife of Aaron Billig, living in Ogle County, Illinois, p. o. Forston [Forreston, in accordance with map review]. (3) Peter Reitz of Northumberland County, Lower Augusta township, p. o. Sunbury (4) Saloma, wife of Jacob Bohner [?], living in Dauphin County, p. o. Pillow (5) Janah Leanah[?], wife of Isaac Fenstamacher [sic] of Dalmatia, Northumberland County (6) Beneville, the petitioner (7) Tobias, the petitioner (8) Barbara, wife of Michael Shellenberger of Juniata County (9) Sarah, wife of Solomon Shellenberger of Juniata County (10) Rachel, wife of Solomon Benner of Juniata County and six grandchildren, to wit:  Henryetta, Mary and Catherine, daughters of Simon Reitz (11), another son of the said Peter Reitz, dec.; and Saloma, Lucy & Jonas, children of Eliza [Elias] Reitz (12), dec., also a son of the said Peter Reitz, and residing in Northumberland County, p. o. Pillow, Penna.  The residence of the children of Simon Reitz is not known.

 By an article of agreement under seal, dated 30 March 1861, the said intestate agreed with Beneville and Tobias, the petitioners, that they were to have all the said real estate was worth on the 1st of April 1867, over and above four thousand five hundred dollars.  No partition of said real estate having been had, the petitioners pray the court to award an inquest to make partition of the said real estate to and among the aforesaid parties according to their respective rights and the intestate law, and the agreement before referred to.  Inquest awarded.  Notice to be given personally to all within forty miles of the County, and by Public Notice, with copy thereof by mail to others more than forty miles off.                             By the court>
