I William Hole of Thorverton in the county of Devon, Gentleman, knowing that it is appointed for all xxx sure to die and thereafter to appear before the just tribunal of Almighty God to answer for the errors committed in this state of mortality and being now in good health and of sound and perfect mind mxxxxx and notwithstanding God be praised therefore, I do proceed to make this my last w and t in manner and form following hoping that the distribution of my effects which I hereby make among my family in the way that I think just and equitable and most for their benefit will be to their satisfaction and induce them to live on terms of friendship love and affection one with the other and above all things my request to them is that they do with the most dutiful regard reverence and respect their mother (if it shall please God that she outlives me) and that they do endeavour to render her as happy and comfortable as her afflicted and unhappy state of health will permit her to be and first I resign my soul into the hands of Almighty God who gave it me hoping through the xxxxx and intercession of a blessed redeemer for a forgiveness of my manifold errors And my body I commit to the earth to be decently interred where and in what manner my family shall think right And as to all such worldly goods and effects as by divine providence I am blessed with I give and dispose thereof in manner following, that is to say, I give and bequeathe unto my son Samuel Hole of Topsham in the said county of Devon, Gentleman, the sum of £1,000 capital stock which I now have in the three per cents in the Bank of England Also I give and bequeathe unto my son William Hole of Woodbury in the said county, Tanner, the like sum of £1,000 capital stock which I now also have in the three per cents in the Bank of England Also I give and bequeathe unto my son John Hole of Cullompton in the said county, Gentleman, the like sum of £1,000 capital stock which I now also have in the three per cents in the Bank of England which said several legacies or sums of money I do hereby order and direct shall be paid and transferred unto my said sons by my executrix herein after named within one year next after my decease Also I give and bequeathe unto Sarah a child which my daughter Sarah, now the wife of Francis Cox of Topsham aforesaid, Gentleman, had before her marriage with the said Francis Cox the sum of £200 in lawful money of Great Britain to be paid to her by my executrix herein after named when and as soon as she shall attain the age of twenty one years or day of marriage which shall first happen And in case she shall happen to die under that age and unmarried then the said £200 shall not be paid but shall xxx for the benefit of my said executrix Also I give and bequeathe unto my said sons Samuel Hole William Hole and John Hole and John Turner of Lxx in the parish of Cxxxbury in the said county, Gentleman, their executors advisers and assigns the sum of £1,000 capital stock I now have in the three per centsin the Bank of England to be paid and transferred unto them or the survivors or survivor of them his executors or administrators by my said executrix within one year after my decease upon trust nevertheless for the sole separate and distinct use and benefit of my said daughter Sarah Cox (the wife of the aforesaid Francis Cox) to be lent at interest or otherwise ordered managed paid applied and disposed of from time to time together with all interest and produce thereof unto such person and persons and for such intents and purposes and in such manner and form as she my said daughter Sarah Cox shall by any note in writing under her hand notwithstanding her coverture and whether married or sole direct and appoint and in default thereof and until such direction and appointment into the hands of her the said Sarah Cox so as the same or any part thereof shall not be applied diverted or appointed to the said Francis Cox her husband to the interest that the same or any part thereof shall not be at the disposal of or subject or liable to the power control debts or engagements of the said Francis Cox her husband but only at her own sole separate and distinct use benefit and disposal And that she shall have power notwithstanding her said coverture and whether married or sole by any will or writing under her hand attested by two or more credible witnesses to give and dispose thereof to such person and persons and in such manner and form as she shall think fit (except as aforesaid and in default thereof then to pay and apply the interest xxxxxx and produce of the same sum of £1,000 capital stock or on whatever other security the same shall happen then to be pxxxxed to the same Francis Cox her husband during his natural life if he shall remain and continue unmarried And after the death or second marriage of the said Francis Cox then in trust that they my said trustees do and shall pay and apply the same £1,000 capital stock or legacy equally unto and between all and every the child and children of her the said Sarah Cox lawfully begotten by the said Francis Cox her husband and if there shall be no such child or children living then unto and to the use of my said executrix her executors administrators and assigns and the receipt or receipts of my said daughter Sarah Cox under her hand shall from time to time notwithstanding her said coverture be a sufficient discharge to the said Samuel Hole William Hole and John Hole and John Turner or the survivors or survivor of them his executors or administrators for the same or for so much thereof for which with receipt or receipts shall be given Also I give and bequeath unto the said Samuel Hole William Hole and John Hole and John Turner their executors advisors and assigns the sum of £1,000 capital stock which I now have in the five per cents in the Bank of England to be paid and transferred to them or the survivors or survivor of them his executors or advisors by my said executrix within three months next after my death upon trust nevertheless and to and for the ends intents and purposes following (that is to say Upon Trust to lend and place the same to such person or persons and upon such security or securities from time to time as my said trustees shall think fit and to pay and apply the interest and produce thereof unto and for the maintenance and education of the said Sarah daughter of my daughter Sarah Cox until her arrival to her said age of 21 years or day of marriage which shall first happen and from and immediately thereafter then upon trust that they the said (trustees or their execs etc) shall and so lend and place the said £1,000 capital stock at interest to such person or persons and on such security or securities and for so long time as the said Sarah the daughter of my said daughter Sarah Cox shall think proper and direct by any writing or writings under her hand notwithstanding her coverture and whether married or sole and pay and dispose of the interest and produce thereof to such person or persons for such intents or purposes as she the said Sarah the daughter of my daughter Sarah Cox shall by any note in writing under her hand direct and appoint And in default thereof into the proper hands of her the said Sarah daughter of my daughter Sarah Cox or otherwise to permit her to receive and take the same to and for her own sole separate and distinct use and benefit to the interest that the said £1,000 or the interest or produce thereof shall not be at the disposal of or subject or liable to the control debts forfeitures or engagements of any husband or husbands that she may at any time or times during her natural life marry with but only at and for her own sole separate and distinct use benefit and disposal ( more stuff saying she can do what she likes ) Also I give and bequeath unto the said John Turner the sum of £50 of lawful money of Great Britain Also I give and bequeath unto each of my said sons Samuel Hole William Hole and John Hole the further sum of £50 each ( of decent money ) to be paid to them respectively by my said executrix within three months next after my decease And lastly I give devise and bequeath all the rest residue and remainder of my money goods chattels rights credits real and personal estate and effects whatsoever and wheresoever not herein before by me given or disposed of subject and liable to the payment of my just debts funeral expenses and legacies unto my dear and loving wife Eleanor Hole her heirs executors administrators and assigns for ever and I do hereby make and appoint her my said wife Eleanor Hole sole executrix of this my last w and t provided always and my will is that my said trustees or either of them shall not be charged or chargeable for more monies than they shall actually receive under the trusts of this my will ( lots more stuff protecting the trustees)
In writing whereof I the said William Hole the testator have to this my last w and t written upon four sheets of paper set my hand and seal to each sheet thereof this twenty fourth day of April in the year of our lord 1793. Witnesses Thomas Ringdon, Robert Turner and John Pugh
