He was the son of William Francis Upshaw (1877-1946) and Annie Gibbs Kinnard (1877-1918).
He was married to author Margaret Mitchell for two years, from September 2, 1922,

until 1924. He is considered to be an inspiration for the character of Rhett Butler in Gone With the Wind.

In 1930, he was in a mental hospital in Raliegh, NC.

He jumped to his death from a hotel in Galveston, Texas on January 12, 1949.

He was 47 years old.
He is buried at Oakwood Cemetery in Galveston, Texas. [6]
