To all people to whom these presents shall come greeting. Know ye that I Samuel Thomas of Marshfield in the County of Plymouth and Province of the Massachusetts Bay in New England yeoman, for and in consideration of the sum of twenty pounds lawful money to me in hand ["well" written over "paid"] and truly paid by William Howland of Pembrook and County aforesaid housewright the Receipt whereof I do hereby acknowledge and My self Therewith fully satisfyed and paid have given granted Bargained sold and by these precents, do truly fully and absolutely Sill Aline Enfeeof Convey and Confirm[d] unto the said William Howland his heirs and assigns forever a Cartain peice of land lying in the Township of Duxbury, it being part of the 109 & 110 lots at the north west End of said lots, and is bounded as followeth beginneth at a stake & stones between two Cart ways which is the corner of 107. & 108 lots and the North west End Rangeth North thirty Degrees Easterly 80 pole and three Quarters to a stake & stones the North East side rangeth South 49 Degrees & half Easterly by 111 lot till it comes to the Cart way that leads from the widow Foords to James Besbes & then along the said road up toward the said besbs till it comes to the stake first mentioned. To have and to hold all the said granted premises and every part thereof with all the profits privileges and appurtunances thereto belonging to the said William Howland his heirs and assigns forever to his and their only use Benefit and behoof forever, and I the said Samuel Thomas do hereby aboveh my self to be the true sole and lawfull owner of the said Bargained premises, untill the Enseeling of these presents and that the same are free and Clear of & from all other grants Bargains Sales and incumbrances whatsoever and hereby Bind and oblige my self my heirs Executors and Administrators forever to warrant the same to him the said William Howland his heirs & assigns, to Defend in the Quiet & peaceable possession of all and Every part thereof, against the legal claims and Demands of all & every person or persons whomesover, in Witness Whereof I the said Samuel Thomas have hereunto set my hand & seal this 19th Day of March in the year of our Lord God, one Thousand Seven Hundred: & Sixty Seven AD 1767

In the Name of God, Amen.

I Samuel Thomas of Marshfield in the county of Plymouth in New England yeoman, being under bodily infirmities but of sound mind and memory, blessd. be God for it. and calling to mind my mortality do hereby do hereby make & ordain this my hands of God that give it, and my boy to the earth to be decently interred by my executor hereafter named, in hopes of a resurrection to life eternal this the merits of the Great Redeemer. and as to my worldly goods and estate with which God has blessed me in this life. I do hereby give & dispose of the same in maner & form following, viz,

Imps. I give and bequeath to my beloved wife Rebeccah Thomas the use and improvement of one third part of my estate both real and personal.

Item. I give to my two sons, viz, Asa Thomas & Abijah Thomas the whole of my homestead farm whereon I now dwell, with all the buildings and fences thereon, to be equally divided between them.

Item. I give to my son Asa Thomas my upper wood lot lying within the township of Duxborough adjoining to that lot which he already hath had, also my piece of salt meadow commonly called my Waterman-meadow.

Item. I give to my son Abijah Thomas my two lower wood Lots lying in Duxboro' aforesaid, and my piece of salt meadow called my Slaughter Island meadow, and also my piece of fresh meadow which I bought of James Thomas.

Item. I give to my daughter Bethiah Rogers the sum of four pounds, thirteen shillings & four pence lawful money, and one half of my houshold goods beside what she has already had.

Item. I give to my daughter Rebeccah Thomas forty pounds lawful money, and also one half of my houshold goods, and also liberty to live in one of my chambers till she is married or other disposed off. and that my two sons viz, Asa & Abijah to be obliged to find her fire wood at the door.

Item. I give to my two sons, Asa & Abijah, all my outdoors moveable estate and all my live-stock, and my weaving apparel to be equally divided between them they being obliged to pay their two sisters the above- mentioned sums or legacies, and also all my just debts, doctors, & funeral charges.

Item. And I constitute and appoint my son Asa Thomas to be the sole executor of this my last will and testament, and i do hereby utterly revoke all other wills, hereby notifying and confirming this and no other to be my last will & testament.

In witness whereof I have hereunto set my hand and seal this nineteenth day of February in the year of our Lord one thousand, seven hundred sixty five. 1765

Letters of Administration on Samuel Thomas Estates, October 17, 1768 [7]

To all people to whom these presents shall come, John Cushing Esqr. Judge of the probate of wills, &c, in the county of Plymouth within the province of the Massachusetts Bay in New England. Sendeth Greeting.

Know ye, that on the seventeenth day of October Anno Domini, one thousand, seven hundred sixty & eight, the instrument hereunto annexed (purporting the last will and testament of Samuel Thomas Late of Marshfield, in sd. county yeoman deceased was presented for probate by Asa Thomas the executor therein named; then present Nehemiah Thomas & Stephen Carver tow of the witnesses thereto subscribed, who made oath, that they saw the said testator sign, seal, and heard him declare the said instrument to be his last will and testament and that they with Isaac Thomas subscribed their names together as witnesses to the execution thereof in the said testator, presence; and that he was then (so the best of their judgement) of sound and disposing mind.

I do prove- approve, and allow of the said instrument as the last will and testament of hte before named deced, and do comit. the administration thereof in all matters the same concerning, and of this estate whereof he died seized & possessed in said county unto Asa Thomas the before named executor, well and faithfully to execute the said will, and to administer the estate of the said deceasd. according thereto; who accepted of his said trust, and he shall exhibit an inventory of all the said deced., estate into the probate office for the said county of Plymouth within twelve months next coming, and he shall render an account upon oath of his proceedings, when thereunto lawfully required.

In testimony whereof I have hereunto set my hand & seal of office the day and year above written.
