On Saturday at Hamilton - before Sheriff Birnie and a jury - James Teevan, miner, was charged with culpable homicide or culpable violation or neglect of duty, by having on 13th April entered a disused side mine in the ell seam of No. 1 pit, Allanton Colliery, going within the fence to a distance of eight feet, and breaking down serveral of the spars, at which place his lamp set fire to and exploded a quantity of fire damp, and the flame ignited a large quantity of wooden props, and John McManus, a roadsman, was suffocated by the smoke, and Thomas Murphy, miner, burned by the explosion. Accused pleaded not guilty, and was defended by Mr Lindsay, Glasgow. The fireman and others gave evidence showing the prisoner was seen to enter the side working, and was found tehre after the explosion. McManus was an old man, who suffered from defective breathing. The explosion ignited the lining and the coal, which burned for a couple of hours, and after the burning was got under, McManus' dead body was found in the main roadway a considerable distance beyond. The defence called witnesses to prove that the screen in the main road at the place was defective, that the miners were in the habit of frequenting the side working, and the fancing was insufficient. The Sheriff summed up unfavourably to accused. The jury brought in a verdict finding prisoner, by a majoirty, guilty of culpable violation or neglect of duty. The Sheriff-Do you mean culpable violation or neglect of duty "whereby any of the lieges were injured;" in other words, was McManus' death due to this culpable violation of duty? The jury again retired and returned with a verdict unanimously finding prisoner guilty as libelled, and strongly recommending him to the leniency of the Court. The Sheriff, taking thi sinto account, and also that accused has already been two months in prison, passed sentence of 14 days' imprisonment.
