Land Transactions

  • 1704 Rent Roll in Nansemond County, Virginia
    • Jno Winbourne - 400 acres[1] [2]
  • 1722- Land Grant East of Chowan River. A patent was issued to Walter Price and Thomas Dyas 26 Apr. 1683 for 400 acres in the upper parish "Nigh the Run of Barbieu swamp" adjoining Winborn's land and Chillcott's headline and etc.[3]
  • On May 1, 1751, John Winburn of Nansemond sold to Joseph Holland son of Henry Holland, deceased, with consent of his wife Phoebe, 75 acres on South Side of Kingsale Swamp [Nansemond County, VA], being part of a patent to Jonathan Robinson etc., dated April 21, 1681, and by conveyance came to John Winburn's wife from her grandmother Phebe Kirl in 1706. Witnesses: Henry Holland, Robert Holland, Job Holland[4]

Research Notes

Phoebe is the daughter of John Sanders and Sarah Davis. This can be established by means of a will and a land transaction in which she was named.

John and Sarah Sanders had the following known sons: Robert, Thomas and Francis. Robert Sanders died unmarried, with no known children. In his will (see abstract below) he leaves his estate divided among the children of his brothers Thomas (Robert, Thomas, Richard, Elizabeth) and Francis (Francis, John). Their children, his niece and nephews, are identified as "cousin," a term used for close kin not just our current definition of cousin.

He also names "my cousin Phebe Winborn." She is the daughter of John Winborne (executor of Robert's will) and his wife Phoebe. If we follow the same reasoning as for Robert's brothers, Phebe Winborn should be the daughter of Robert's sister. So John Winborne's wife Phoebe must be Phoebe Sanders.

  • Sanders, Robert: Of the Lower Paris. Leg; -to Cousin Robert Sanders, son of Thomas Saunders, dec., the dwelling plantation where I live north side of Queen Grave Swamp and for want of heirs to cousin Francis Saunders, son of Francis Saunders; to cousin Eliz. Saunders, dau. of Thomas Sanders decd. rem. of land, if she died, to her brother Thomas Saunders; to cousin Richard Saunders, son of Thomas Saunders, 170 acres adj. where I live, if he died without heirs to John Saunders, son to Francis Saunders; to cousin Thomas Saunders son to Thomas Saunders, decd., 208 acres, land called "Half Moon"; to my cousin Phebe Winborn. To cousin Francis Saunders, oval table; to cousin Robert Saunders, son of Thomas Saunders, decd., all rem. est. Exrs. John Winborn and Robert Saunders. (signed, Sanders) Pro. 27 Dec. 1731. Wit. Richard Thomas, Jno. Thomas, Lawrence Wolferston. (W. & D. -431)[5][6]

Another proof that Phoebe is a Sanders is the sale of land by John Winborne and his wife Phoebe in 1751 (see land transactions above). In it the land is described as being part of a patent to Jonathan Robinson, Richard Thomas, and Jno. Sanders "dated April 23, 1681, and by conveyance came to John Winburn's wife from her grandmother Phebe Kirl in 1706." Phoebe's grandmother referred to here is Phoebe, the mother of Phoebe's father, John Sanders.

Based on research and sources provided, I propose to remove Richard Thomas and Elizabeth Marshall as parents of Phoebe Winborne and replace them with John Sanders and Sarah Davis. Relevant sources and proofs are included above. Please respond with any comments, objections, etc.
