(5) Stephen Horsey Livingston Born 1758 in Somerset Co., Maryland Died: April 02, 1779 in Worcester Co., Maryland Stephen Horsey Livingston served as an Officer in the MD Militia in the American Revolution. On August 30, 1777 he was recorded as having the rank of 2'nd Lieutenant with Captain Samuel Horsey's Company in the Wicomico Battalion in Worcester Co., MD. I believe this particular Samuel Horsey to be Stephen's Mother Sarah Horsey's Cousin, son of her Uncle Anthoney Smyth Horsey, Sr. See 'Archives of Maryland', 16: 351 at the Maryland Historical Society Research Library in Baltimore, MD. Also see S. Eugene Clements and E. Edward Wright, 'The Maryland Militia in the Revolutionary War' Appendix A - Commissioned Officers, page 98.

Stephen (Horsey) Livingston took the Oath of Allegance in Worcester Co., MD in 1778 before the Honerable (Judge) William Hopewell. See Manuscript MS-1814, Box 4, (Revolutionary War Military Collection Manuscript), at the Manuscript Division of hte Maryland Historical Society at No. 201 West Monument Street, Baltimore City, MD. See Also: Henry C. Peden, Jr., 'Revolutionary Patriots of Worcester & Somerset Counties, Maryland 1775 - 1783', published 1999 by Willow Bend Books & Family Line Publications, Westminister, Caroll Co., MD, Pages iv, 180.

Stephen Horsey Livingston's name appears again in the MD Militia during the Revolution, along with his brothers George and Todd, at this same rank within this same Company in Wicomico Battalion records dated July 15, 1780. This time not only does Captain Samuel Horsey appear to be leading the company, but there is also listed a 'Samuel horsey' in the Company listed as holding rank '7'th. Class'. It is extremely interesting as it was believed that he had died by April 2, 1779. Perhaps they were slow or inconsistant updating Military records in the Revolutionary era ??

Stephen Horsey Livingston's will was written March 6, 1779 and executed April 2, 1779 in Worcester Co., MD. The Witnesses to his will were: Joseph Cathell, Isaac Dixon, and Samuel Horsey. In his will Stephen left his lands to his Mother Sarah (Horsey) Livingston for her lifetime, afterwards to be passed to Stephen's brother Benjamin Livingston. See Will Book JW-4 1769 - 1783 Worcester Co., MD, page 419. Also see David V. Heise, 'A Closer Look at Worcester County Wills', 1991, page 54.

Stephen Horsey Livingston never married and allegedly upon his death left all his estate and belongings to his Mother Sarah Horsey.
