Margaret Ellen Garton was born in 1859 at Bathurst, New South Wales, Australia. She was the daughter of Franklin Garton and Harriett (Ridgeway) Garton. [1]

Zeitsch v Zeitsch. — In this case Mr. Whitfield appeared for the petitioner, Jacob Zeitsch.
The petitioner sued tor a divorce from his wife, Nelly Margaret Zeitsch, on the ground of adultery. The parties were married at Grafton in September, 1876. They went to live at Paddington. The co-respondent, Arthur Haverley (sic) [Haberley], lived next door to them. In August last year respondent returned from his workshop, and found coespondent and respondent locked in an empty house. Respondent said she had gone there to read a book and get away from the children. Subsequently they had a row over this incident, and petitioner admitted her impropriety with the co-respondent. A decree nisi, to be made absolute in six months, was granted. [3]

A THRIFTY WIFE.
AND A CARPENTER'S EARNINGS. 'SHE THREATENS TO RUN AWAY.' TROUBLE IN THE HOUSEHOLD. HABERLEY'S STORY.
A case possessing some rather peculiar features was heard at the Perth Police Court this morning, when Arthur Haberley was charged before Mr. A. S. Roe, P.M., with having at Cottesloe on February 12 — (1) Unlawfully assaulted his wife, Nellie Garton Haberley, (2) assaulted P.C. Taylor; (3) damaged a police helmet, the property of P.C Taylor, valued at 11s. Sergeant Thomas conducted the prosecution. The accused, who was undefended, pleaded not guilty to the first charge and guilty to the second and third. Constable Taylor, of Cottosloe, said that in consequence of a telephone message received yesterday at 1 p.m. he proceeded to the accused's residence. As a result of something he was told by the accused's wife, he asked him if he had threatened to cut her throat with a razor. The accused replied that he had not, but that he had taken out his razor to have a shave. He was in a very excited state, and witness thought it best to take him away. He asked him to accompany him to the police station. They walked along quietly as far as the railway station, when the accused turned round and struck witness full in the face, causing blood to flow freely. There was a struggle, and ultimately witness got the upper hand, and succeeded in taking the accused to the police station. During the struggle his helmet, which was valued at 11s., was badly damaged. The accused was by trade a carpenter.
During the last six months the Cottesloe police had been called to his house some six times. By the Accused: He had never seen any signs of disorder in the house. Nellie Garton Haberley, the accused's wife, said that yesterday morning she got up as usual shortly before 8 o'clock, and started to prepare breakfast. Her husband came into the kitchen in a frenzy of rage. He picked up a knife and told witness he would 'settle' her. She evaded him and rushed from the room into the vestibule. He pursued her and said, 'I'll cut your __ throat.' Then he got a razor, and repeated the threat. He said, 'Let me tell you this; this is your last day ! I will settle you to-day.' Witness ran out of the house and took refuge with her neighbors. Later she heard a scream, and knew he was knocking her girls about. One of them rushed in and said, 'He Is sharpening a table knife, and says that he will settle you, and that he is going to smash up everything in the house.' Witness then sent for the police and gave accused in charge; she could do nothing else. She did not think accused was in his right mind. He accused her of robbing him of his wages. By the Accused: Five years ago she had been possessed of £100; to-day she had about £50. She also owned two blocks of land at Cottesloe. Constable Lynn, of Cottesloe, deposed that the first trouble between the accused and his wife arose about three years ago. It concerned certain moneys in the bank. The accused's wife would not tell him what amount of money she had got, and what she was doing with it, and he was not at all satisfied. He was a very hard-working man, and never touched drink. His family was always well dressed and respectable. His wife stated that she had £ 300 in the bank at the time of her marriage. The accused had an ungovernable temper, and was quite irresponsible for his actions when it got beyond his control. This closed the evidence for the prosecution. The accused, in the witness-box, stated that he had been married to his wife for about 19 years. They had come to Western Australia 14 years ago. When they landed his wife had £107. He worked in Perth for a year and nine months, and they then took a trip to Sydney. Subsequently witness became ill, and on this illness and on the trip to Sydney they spent £133 out of £135 they had saved. They then went to Kalgoorlie, where they stayed for three years, and witness built a house with money given him by his wife. When they left Kalgoorlie she had £145 and he had £6. At the present time his wife had £79 10s., two blocks of land (for which he had paid), and a piano partly paid for. The trouble was that witness wanted to know what his wife did with his earnings, and why she took them from him. At Christmas she had given him £2 for a Christmas-box. He had given it back to her to mind, and subsequently she told him that she had spent £1 and put the other towards the payment of her piano. (Laughter.) Mr. Roe: Who has been compelling you to give your money to her? At any rate isn't it better to give it to a wife who is thrifty and careful, as your wife is, than to keep it yourself and perhaps squander it? Accused: I suppose it is, your worship. Sergeant Thomas: What's wrong with keeping back 10s. of your salary each week? (Laughter.) Accused: Then she threatens to run away from me! (Laughter.) Mr. Roe: At the bottom of it all lies that ungovernable temper of yours. The fact that your wife won't tell you what she does with her money is no justification for your behavior. You will do serious harm some day if you go on as you are at present. I am going to call upon you to find one surety of £10 to keep the peace to-wards your wife for the next 12 months, and I am going to fine you 40s, for assaulting P.C. Taylor, and order you to pay 12s. 6d. the cost of the damage done to his helmet. Accused: Thank you, your worship, [9]
