There are two Goochland Co. VA Chancery court cases referencing the children of John Ellis & 1st wife Mary Nunnelly and 2nd wife Mary Magdalene Ellis:

The first is an 1823 Goochland Co. VA Chancery court case ^[1] wherein on page 10 states: Jno Ellis Dec'd - leaving Henry Mallory & Becky Ellis his wife, Eleazer Ellis, Josh Watkins & Jarusa Watkins late Ellis, Benjamin Phopet & Elizabeth his wife late Ellis, Joshua Ellis (Kentucky), Harrealis Ellis (Kentucky), Absalom Ellis, Bartholomew Ellis (Kentucky), Leroy Ellis, John Ellis & Charity his wife late Ellis, Calup Ellis who has died leaving heirs in Goochland,

The 2nd is an 1844 Goochland Co., VA. Chancery court case ^[2] involving the estate of Absalom Ellis dec'd (son of John Ellis and his wife Mary), reference Absalom Ellis's siblings, the uncles and aunts of Absalom Ellis, as well as on page 10 the the 1844 Chancery case lawsuit that Mary Magdalene Ellis was the mother of Absalom Ellis. Reinforcing John Ellis's marriage to Mary Magdalene Ellis is the statement on page 9 of the 1849 booklet 'A Memorandum on the Ellis Family" wherein it states "Charity Ellis, the daughter of John Ellis, (the son of ) and Mary Magdalene Ellis (the daughter of Joseph Ellis).

Mary Magdalene Ellis and Mary Nunnelly were two different wives of this John Ellis , as proven by 1830 Henrico Co., VA U.S. census as Mary M. Ellis is listed as 70-80 years old, which means she was born between 1750 to 1760 making her too young to be the mother of the children before Absalom Ellis was born. Net result Mary Nunnelly and Mary Magdalene were two Mary's. both wives of John Ellis merged over time. Page 38 of this Chancery court case shows that Mary Magdeline Ellis (mother of Absalom) was still alive on the 18 April 1839 being "very old, and very deaf, and almost entirely blind, and that he (Benj. Phaup) believes she is wholly incompetent to manage her property or pecuniary affairs".
