• In the suit in which Eileen Hilda Dobbie, formerly Fowler, a minor, by her guardian, Elizabeth Glover, applied for a decree against John Hastings Dobbie for restitution of conjugal rights. Mr. Tucker, who (instructed by Messrs. Heydon and Heydon) appeared for the petitioner, asked for leave to withdraw the petition. His Honor said he had come to the conclusion, having considered the authorities,

that a married woman, even under the Married Woman's Property Act, could not act as guardian for a minor in the presentation of a petition in divorce. The petition was accordingly withdrawn, and, in view of the importance of the decision. his Honor asked that it be recorded in "Weekly Notes."
