To the Honorable Nicholas Ridgely, Esquire Chancellor of the State of Delaware, now countenancing the Orphans Court for Sussex County ~~ The Petition of William Deputy Administrator of Charles Deputy deceased late of Sussex County, deceased humbly sheweth that the personal Estate of the said deceased is not sufficient to pay and discharge the just debts of said deceased, as may appear by a Statement of the settlement of said Estate, from the Register of the County aforesaid, and a list of debts due from the said deceased, herewith exhibited ~~ Our petitioner therefore prays your honor to grant him an Order, empowering him to make sale of the Real Estate of said deceased Situate lying and being in Cedar Creek hundred, and County aforesaid,Containing Seventy five acres more or less adjoining the lands of William H______, Eli Williams and others, or so much thereof as will enable him to pay and discharge the just debts of said deceased, according to an Act of the General Assembly on the State in such case made and provided. And your petitioner will ever pray (ye). – William Debuty Amount over paid the Estate of Charles Deputy by the Administrator William Deputy agreeable to the last settlement on said Estate made June 12th, 1820. ~~ $220.32½ Register’s office July 15th, 1822, Nathan Vicker, Reg.   5. William Deputy; 1818 Mentions brother Charles Deputy having pre-deceased William prior to the writing of this will. In the Name of God Amen I, William Deputy of the County of Sussex and State of Delaware, being advanced in years and feeling the infirmities of age coming on but enjoying a sound and disposing mind and memory (praise be god for the same) and being desirous to settle my worldly affairs whilst I have strength and capacity so to do, do make and publish this my last will and testament hereby revoking and making void all former wills by me at any time heretofore made, and first and principally I commit my Soul into the hands of my Creator who gave it; and my body to the Earth, and as to such worldly estate wherewith it hath pleased god to intrust me, I dispose of the same as followeth, and first I will that all my just debts as shall be by me owing at my death, together with my funeral expenses and all charges touching the proving of or otherwise concerning this my Will be paid as for…after my decease as conveniently may be and I give my lands tenements and hereditaments, situate lying and being in Cedar Creek Hundred, County of Sussex and State of Delaware,bearing the name of the hearn(?) tract to be equally divided between my five daughters: Namely, Comfort, Betsey, Sally, Polly and Castilla, and further I will that all that tract or parcel of Land Situate lying and being in the Hundred, County and State aforesaid bearing the name of the White Oak Swamp(formerly the property of my brother Charles Deputy at whose death I became possessed of a moily or one-half) be equally divided between my two granddaughters Susan Layton and Susan Hoffaker and I Nominate and appoint James Hoffaker of the County of Kent and State aforesaid Executor of this my Will in witness whereof I the said William Deputy have set my hand and Seal declaring it to be my last will and testament this second day of January in the year of Our Lord, one thousand eight hundred and eighteen, Signed, Sealed, and delivered in the presents of us who have at his request and in his presents Subscribed our names.
