Biography

Joseph Buie was born in 1801 in North Carolina to Duncan Buie and Sarah Susannah (Unknown).

He married Salina Leavens[1] [2]and they made their home in Franklin Parish, Louisiana.[3][4][5]

Salina appears to be the widow of John Doyal. Her marriage record shows her name as Doyal when she marries, John Doyal is no longer in the census records and her son, John Doyal and daughter Mary Doyal are living with Salina and Joseph in 1850.

The Franklin Sun burned in 1923 and old records are not available in any consistent and searchable format. The following was found in a frame on the wall of a bed and breakfast house in Winnsboro, Franklin Parish, Louisiana. The legal document for the original lawsuit may be available.

Salina Buie vs. Joseph Buie
12th Judicial District Court- Parish of Franklin
By reason of the law and the evidence in this case being in favor of the plaintiff, it is ordered, adjudged and decreed, that the community of acquets and gains heretofore existing between the plaintiff and defendant, Joseph Buie, be and the same is hereby dissolved and declared at an end. It if further ordered, adjudged and decreed, that the plaintiff, Salina Buie, be declared to be the owner of the plantation in Lake Prairie, known as the John Doyal plantation, containing five hundred and sixty three acres, more or less, with all the improvements thereon: also the south east quarter of sec 29, T 13, R 6 E, also , the south west qr. of S W qr of sec, 28 T 13, R 6 east, together with five mules, five horses, the stock of cattle, one hundred head, more or less, the stock of hogs, one hundred head, more or less, be declared and decreed to be the separate property of the plaintiff, Salina Buie.
It is further ordered, adjudged and decreed, that the plaintiff do have and recover of the defendant the sum of thirty hundred and one dollars, with 5 pr cent interest of seventeen hundred and one dollars thereof since March 1st 1849, and the like rate of interest of the sum on one thousand dollars since March 1st 1850, and the like rate of interest on the other eight hundred dollars of said judgement, since the 1st of January, 1863, and costs of this suit. It is further ordered, adjudged and decreed, that the plaintiff's legal and tacit mortgage be reorganized according to law, for the sum of seventeen hundred and one dollars since March 1st 1849, and for the sum of one thousand dollars of this judgment since March 1st 1850, and for the remainder, eight hundred dollars, since January 1st, 1863.
