Record # 60

Julia Bell wife of William Bell, decd who emigrated to Texas in January 1834 and died in July of the same year and Thomas H. Bell and James M Bell, sons and heirs of age of the said William and (Andrew) Jackson, John P., Joseph J Bell, Adaline, Granville, and Frances, children and minor heirs of the said William Bell represented by their natural guardian Julia Bell presented their claims to the Commissioners for one league and labor of land as the universal heirs of the said William Bell, deceased and prayed for a certificate for the same. James Duff witness for the claimants deposed that the deceased William Bell emigrated to Texas with his family in the month of January 1834 and died in Jly of the same year and the witness further deposed that the said Bell decd never received the head right to which he was entitled. Clement Allen deposed to the best of his knowledge and belief that the deceased nor his heirs have not previously recd a title to the quantum of land to which the said deceased was entitled as his head right. The Board having investigated said claim and being satisfied the said William Bell decd acquiring the said head right of one league and one labor of land previous to his death issued to the above named heirs of said William Bell decd a certificate for the same.

Sons James M Bell and Thomas H Bell also applied for a league and a labor in records number 58 and 59. These all subscribed to the oath required by Law “I do solemnly swear that I was a resident Citizen of Texas at the date of the Declaration of Independence, that I did not leave the country during the Campaign of the Spring of 1836 to avoid a participation in the Struggle, that I did not refuse to participate in the war, that I did not aid or assist the enemy, that I have not received a title to my quantum of land and tht I conceive myself justly entitled under the Constitution and Laws to the quantity of land for which I apply.” Both of these brothers actively participated in the struggle. James was awarded land for having participated in the Battle of San Jacinto.

According to Land board hearing which are referenced in the book " From Jamestown to Texas, A History of Some Early Pioneers of Austin County, Texas, the Colonial Capitol of Texas" by Betty Smith Meischen and available on line at google.com/books:
From these records we find that James M. Bell and Thomas H. Bell immigrated to Texas in January 1834 (from Tennessee) with parents William and Julia Bell and siblings William, Jackson, John P, Joseph J, Adaline, Granville and Frances.

"On file in the Bellville, Austin County Courthouse are minutes of the land boawrd at San elipe d Austin, Jan. 19, 1839, which were to determine legal claims to land after the Battle for Indepenence in Texas was faught in 1836 and it became a Republic. Items Number 58, 59, and 60 were presented by James W. Each took the oath required by law "I do solemnly swear that I was a resident citizen of Texas at the date of the Declaration of Independence, that I did not leave the country during the Campaign of the Spring of 1836 to avoid participating in the struge, that I did not refuse to participate in the war, that I did not aid or assist the enemy, that I have not received a title to my quantum of land for which I now apply." James BEll claimed one-third league of land, indicating that at the time of his original claim and his intent was to farm and ranch. William Bell had also made the same claim. In these documents it states that William and Julia Bell came to Texas in January 1834 with their minor children. William died that same year in July. It is recorded in the marriage records at the Austin County Courthouse that Thomas Bell married Abigail Grimes on Nov. 13, 1828, one of the earliest recorded marriages in the colony.
