Will of father, Joseph Ball

15 Nov 1721
In the name of God Amen. I, JOSEPH BALL, of the County of Northumberland, being sick and weak of body, but of perfect mind and memory, praise be to Almighty God for the same, and calling to mind the uncertainty of this life, that it is but a blast, I do therefore make and ordain this to he my last Will and Testament in manner and form following. Imprimis, I give my soul to God that gave it to me, in full and certain hope of pardon and remission for all my sins, and through the merits of my dear and blessed Saviour Jesus Christ, and my body to be decently buried according to the discretion of my Executors hereinafter named: and as for what temporal estate it has pleased Almighty God of his great goodness to bestow upon me, I give and bequeath as follows: Item, I give to my two sons, Spencer and Richard Ball, all that tract of land that I now live on, being about 1500 acres, which was formerly settled on them by deed, but supposing that Spencer's part will take some of the land above the glade, my desire is that the glade shall be the division between them; and I do give my son, Spencer Ball, and his heirs forever, one negro man named Gie, in consideration that he make over to my son, Richard Ball, and his heirs male forever, lawfully begotten of his body, all his right, title and interest of the land aforesaid, lying above the glade, and for the want of such issue, to return again to my son Spencer, &c., and in case my son Spencer fail to perform the same as aforesaid, then I give the aforesaid negro to my son, Richard Ball, and his heirs forever. Item, I give to my daughter, Sarah Ball, my land in Richmond Co., to her and her heirs forever, provided my loving wife give each of my two sons, viz: Joseph and William Ball, part of her land at Black Point, but in case my wife should not give my said sons part of her land, that then I give my land in Richmond Co. to my said two sons, Joseph and William Ball, and their heirs forever. I give my dear and loving wife all the negroes I had with her and one negro boy named Tom, and after her decease I give the said Tom to my son, Richard Ball, and his heirs forever. I give my dear wife my horse named Sprite. Item, I give my son, Richard Ball, one negro man named Cuffy, to him and his heirs forever. Item, I give to my three children, viz., Sarah, Joseph and William Ball, six negroes, viz., Harry, Jenny, Nan, Hannah, Winny and Billy, to them and their heirs forever, and my will is that each of my said children shall have their proportional share of the said negroes and their increase delivered to them, as they, my said children, shall come of age, or at the day of marriage. Item, I give my son Spencer my young black horse. Item, I give all the rest of my estate not heretofore given, unto my dear wife and five children, viz., Spencer, Richard, Sarah, Joseph and William Ball, to be equally divided among them. Item, my will is that my loving brothers, Richard and Geo. Ball, have the tuition of my children and the management of their estate; notwithstanding it is my desire that they do not take my children from their dear mother, upon any account than as they shall think reasonable for the better educating them, nor their estate without she marry again, and that her then husband should prove unkind to my children, and not take provident care of them and their estate, that then my desire is that my said brothers take upon them the whole care of my children and the management of their estate. Item, I do hereby nominate and appoint my dear and loving wife executrix of this my last Will and Testament, and I do revoke and make null and void all former Wills and Testaments by me made, and I do hereby ratify and confirm this to be my last Will and Testament.

In witness whereof, I hereunto set my hand and seal this the 19th day of 8ber(?), 1720. JOSEPH BALL [L.]
Signed, sealed and delivered in the presence of David Ball, Jno. Jossy, Jno. Lacy. December 15, 1721.

Probated, North'd Co., "to be the last Will and Testament of Capt. Joseph Ball, dec'd," &c. Teste Richard Lee, Cl'k Ct.

Will proven in Northumberland Co. VA, Record Bk 1718-1726, pg 225-226.

Something wrong here . Sarah was born in 1714 and married in 1715???
Ball-2211 and Ball-1295 appear to represent the same person because: It appears the previous "unmerged match" was pending merging of the parent entries, which has now occurred.
