James was killed in a fight with his illegitimate brother Gilbert sometime before 8 November 1408.[3]

Scots Peerage shows that Sir Gilbert had a son James and a son Thomas. The children listed in each profile are not the same children. Scots Peerage does not list a wife or children for Thomas.
Kennedy-3873 and Kennedy-996 appear to represent the same person because: Similarities in name and place of residence. Same son. No dates or sources on Kennedy-3873. Thanks.
