In October 1878, Constable Thomas McIntyre was the the only surviving witness to the murder of three Irish born policemen by the Kelly Gang at Stringybark Creek. At Ned Kelly's trial, McIntyre stated that Kelly had fired the first shot, killing Constable Thomas Lonigan.

Sole surviving witness to the murder of his three colleagues at Stringybark Creek on October 26 1878 by the Kelly Gang, Constable Thomas McIntyre spent much of his life coming to terms with what he'd witnessed. Retiring from the police force at the young age of 35 due to ill health, McIntyre wrote what could be considered the first history of the Kelly Gang. The un-published manuscript details his eyewitness description of the murders and his encounters with Ned Kelly over the course of the following years.

After they arrived they received a warning that four policemen were planning to track them down. The gang ambushed the police camp at Stringybark Creek[13] and found two of the four policemen – Constables Lonigan[14] and McIntyre[15] sitting around a fire. The gang drew their guns and Ned shot Lonigan and McIntyre surrendered.
