Note N2036The Commonwealth of Pennsylvania to the Sherriff of Union County Greeting -- Whereas at an orphans court held at New Berlin the nineteeth day of May A.D. Eighteen hundred and Seventeen Before the Honorable Seth Chapman Esquire President and his associate Judges of the same court, Jacob Haflich intermarried with Elizabeth late Elizabeth Sellers eldest daughter and heir at law of Tobias Seller late of Perry Township in the county aforesaid deceased that the said Tobias Sellers lately died intestate leaving a widow name Catharine and some two children, to wit, Elizabeth intermarried with your petitioner, and Mary who is a minor about the age of seven or eight years though a guardian over her person and estate has this day been appointed and that the said intestate died seized in his demise(?) as of fee of and in two tracts of patented land situate in Perry townships aforesaid, one of which is bounded by lands of Charles Stroup, Philip Puff and others containing two hundred and thirty one acres or thereabouts- and the other tract is bounded by land of Frederich Kritzer, Samuel Shadle and the heirs of Christian Furry deceased, containing one hundred and fifteen acres or there abouts with the appurtenances. Your petitioner therefore prays your honors to award an inquest to make partition of the premises aforesaid, to and among the children & representatives of the said deceased in such manner and in such proportions as by the laws of this commonwealth is direct- if such partition can be made without prejudice to or spoiling of the whole but if partition can not be made thereof as aforesaid then to value & appraise the same and further to inquire and assertain wither the said real estate with the appurtenances will conveniently accomodate more than one of the children of the said intestate & if so how many of the said children it will conveniently accomodate and make report of their proceedings to the next orphans court. Witness the honorable Seth Chapman Esqr. President of our said court at New Berlin the Nineteenth day of May Anno Domini one thousand eight hundred and seventeen. Simon Snyder Junr Clk. Union County P. To the Honorable the Judges within named. I do certify that by virtue of the within writ to me directed (having first duly warned the parties) I took with me twelve free honest and lawful men of my Bailiwick and went to the lands and all and singular the premises therein mentioned and there by their oaths and affirmations find the same would currently accomodate the two children of the intestate, have valued and appraised the same, as by the within writ I am commanded, as by the schedule herunto annexed apprais. So answers Fredk Wise Shff. Sept Term 1817: Frederick Wise, High Sheriff of Union County, made return of a writ to him directed returnable here the third Monday of September A.D. Eighteen hundred and seventeen, commanding him to summon an inquest to make partition of the real estate of Tobias Sellers therein mentioned died seized to and among the widow children and representatives of said deceased according to Law, if such Partition cannot be made without prejudice to or spoiling the whole otherwise to value and appraise the same and make return thereof according to Law which return was made in the words following to writ. Inquisition indented and taken at the late dwelling house of Tobias Sellers late of Perry township in the county of Union deceased, on the eighteenth day of August in the year of our Lord one thousand eight hundred and seventeen. Before Frederick Wise Esquire High Sheriff of the County of Union aforesaid, by virtue of a certain writ of Partition and valuation ??? out of the Orphans Court of the County aforsd to the said Sheriff directed and to this inquisitian annexed by the oaths of Samuel Shadle, Valentine Haas, George Rinard, Peter Lumberd, Jacob Steffy, Michael Meiser, John Shiaffer, Henry Ramstone, Leonard Smith, Andrew Rumfut, affermations, John Shnee & Michael Shaffer, twelve good and lawful men of this bailiwick of the said Sheriff who their oaths/ and affirmations respectively do say that they went to the lands and premises in the annexed writ described to wit, two tracts of patented lands situate in Perry township aforesaid, ... upon view of the tracts aforesaid do find that the said two tracts of land with the appurtenances cannot be divided between the widow and both the children of the said deceased without prejudice to and spoiling of the whole. And the Inquest aforesaid ... do further say that they have viewed, considered and inquired whether the said two tracts will conveniently accomodate more than one of the said children of the said deceased without prejudice to and spoiling of the whole --- and do find that the first above mentioned tract containing two hundred and thirty one acres & allowances will conveniently accomodate one of the children ... and that the second...will conveniently accomodate the other child ... and have valued and appraised the first ... tract with the appurtenances at and for the sum of ten dollars and seventy five cents cash for each and every acre with the allowance, and ... the second... tract for the sum of ten dollars cash for each and every acre with the allowance making the valuation of both tracts amount to three thousand six hundred and thirty seven dollars and seventy five cents lawful money of Pennsylvania. ... To the Honorable the judges of Orphans Court now sitting at New Berlin in & for the County of Union, The petition Jacob Hefley intermarried with Elisabeth Seller daughter of Tobias Seller late of Perry Township in Union County aforesaid Deceased, Humbly Sheweth that the real estate of the said Tobias was valued and returned to this court and that your petitioner refuses to take the said real estate at the valuation and therefore prays your honors to make an order for the sale of the same-- and he will pray Jacob Hoflich Public Notice is hereby given that by order of the Orphans Court of the County of Union will be exposed to Sale by Public Vendue or Outcry on Tuesday the third day of February Next at ten OClock in the forenoon of said day ---- two certain tracts of patented lands situate in Perry township county of Union. One of which is bounded by land of Charles Stroup, Philip Puff and others containing two hundred thirty one acres and allowances. The other tract is bounded by lands of Frederick Kritzer, Samuel Shadle, and the heirs of Christian Furry deceased containing one hundred and fifteen acres and seventy six perches with the appurtenances late the Estate of Tobias Zeller deceased. The sale will be held on the premises and the terms made known by Adam Light Admistrator of said Estate. December 19th 1817 By the Court Simon Snyder Junr Clerk. Adam Light, Administrator of the estate, made several moves to continue the sale of the property as no bids were received that would have prevented loss to the estate. Continuance was granted.
