According to the abstract of the Will of Hugh Sherwood in The Maryland Calendar of Wills, 1635-1743 it appears that sons Francis and Hugh were alive at the time of his death.

"Sherwood, Hugh,Talbot Co.,19th Jan., 1710; 22nd Mch., 1710. To granddau. Elizabeth Hambleton, personalty. To sons Francis and Hugh, residue of estate, real and persona; son Francis to have all land excepting tract “Crooked's Intention,” which is bequeathed to son Hugh. Last named to be of age at decease of testator. Exs.: Sons Francis and John. Test: Ralph Rice, Katharine Rice, William Hambleton. 13. 243."

This is further confirmed in an entry in the Maryland Archives in the Acts of 1712, ch 13, pg 48 where we find an Act relating to Hugh Sherwood's Will.
