Thomas McConville's cause of death seems to have been an accident with a horse on Boxing Day 1873, at Muttbilly races.

GOULBURN POLICE COURT. WEDNESDAY, JANUARY 28 1874 BEFORE the police-magistrate and Messrs. Sheppard and Dickson. One drunkard was fined 5d., and another 10s. or three days in gaol. Robert Humphreys, on bail, charged with the manslaughter of Thomas McConville at Breadal bane, was again brought up. James O'Brien deposed: I was at the races at Muttbilly on Boxing-Day; I saw Michael Gleeson there on horseback, galloping round the race-course, with a boy in company with him; they were riding at a furious pace; there was a crowd a few yards from the running-ground; they rode into the crowd ; had they kept on the course they would not have run into the crowd; I did not see them slacken their pace; I can't swear to seeing prisoner on the course that day, but I think I did; I saw a man named Thomas McConville knocked down by one of the two horses, but can't say by which; McConville was unconscious, and was carried to the Red House ; the man and boy had a tight rein on their horses, and were sitting back in their saddles; I believe they were trying to stop their horses just before coming into the crowd; a woman was also knocked down. John Clear, a labourer at Bohara, gave corrobo rative evidence, but also identified prisoner as one of the two who were riding round the course, and aware that it was Gleeson's horse that knocked McConville down. Frederick B. Hornbrook, M.R.C.S.,L., deposed as to the injuries received by Thomas McConville, and as to the cause of death. James Maguire, farmer at Muttbilly, was at the races, saw McConville knocked down, and recognised the prisoner as answering the description of a boy he saw galloping into the crowd in company with Gleeson. Henry Slater was at the races, and recognised the prisoner as having galloped with Gleeson round the course, but swore that prisoner pulled off behind Gleeson, and did not go into the crowd at all ; he thought both had command of their horses. Prisoner was committed to take his trial at the next circuit court to be held in Goulburn. Bail al lowed-two sureties in £40 each.
