John Hale was born about 1810 in Virginia and died in 1887 near Magoffin, Kentucky.
About 1878, John's daughter Martha is born. Her mother is Mary Ann Collins who marries John Colvin in Magoffin, Kentucky in 1882.
Before his death, John marries Lear Eldridge, the former wife of Daniel Trusty. (Daniel's daughter Nancy is John's daughter-in-law.) John and Lear are married in Breathitt, Kentucky by William S. Allen. They live for a few years on the land of John and Nancy J. Gardner in Salyersville, Magoffin, Kentucky.[1]

Military Service
Though advanced in years, John served as a private in two regiments of the Confederate States Army during the Civil War. He enlisted on 14 December 1861 in Company A of the 5th Kentucky Mtd. Infantry. He mustered out on 20 October 1862 as "absent with leave from the Col."[4]
John reenlisted in November 1862 in Company A of the 10th Kentucky Calvary. He was captured at Cynthiana, Kentucky on 12 June 1864. He was paroled on 15 March 1865 and took the oath of allegiance to the United States on 26 June 1865.[5]
Research Notes
Birth: The exact year and County of John's birth is uncertain. His son William states John was born in 1808.[6] His widow Lear states he was born in 1810.[1] His census records have 1815/1820. While John's place of birth as Virginia is consistent with records, the County of his birth is not. The birth record of John's son Brackenridge states John was born in Wythe, Virginia. According to the Wythe County Historical Society, no Hale family was living there when John was born.[7] His son William states John was born near Evington, Virginia. William himself was born in Russell, Virginia.[6] His widow Lear states John was born in Lebanon, which is a town in Russell County, Virginia.[1]
Parentage: After taking Y-DNA and Autosomal tests and using various DNA tools, descendant John Hale discovered that Michael Aker is John’s biological father. John’s mother may be someone other than Michael Aker’s wife. Note: This DNA evidence contradicts his son William's statement that John's father died when John was about one year old.[6]
Siblings: His son John states that his father had three other siblings: James, Washington, and Sallie Hale.[8] No additional information was provided about these siblings.
Death in 1887: John likely passed away sometime in March or April of 1887. His son John states that his father died on 20 March 1887.[8] His widow Lear states that John died in April 1887.[1] John's burial clothes were supplied with Magoffen County funds in 1887.[9]
Birth mother of William: The birth mother of William is uncertain. On his Eastern Cherokee Application, William states that his mother was Sarah Fawbush.[10] However, William is the only child born in Virginia about a decade before his other siblings. While he states that Sarah Fawbush was Cherokee on his application, in a later statement, he states that his mother was "a white woman."[6]
Branch W. Higgins states that John worked for his father John. John Higgins was a farmer.[1]
John is not the Rev. John Hale who passed away on 20 November 1882 and was buried at McGuire Cemetery in Morgan County, Kentucky.
