GIVEN NAME: "Isajas (gewöhnlich Joseph Gernsbacher genannt)"[1]

MARRIAGE COMPLICATIONS: Joseph Gernsbacher, born in Bühl (Baden), Germany, was married twice with his first wife Breine Kahn.

First in the year 1854 in New Orleans he married Breine (Bienche) resp. Philippina Kahn who was born in Bodenheim, Rheinpfalz (Palatine), Germany. They had a traditional Hebrew marriage in a synagoge, a civil record probably didn't exist. In New Orleans in the year 1855 the couple got a son named Aron. Later the young family went to Bühl (Baden) and got a daughter Sophie in 1862.

The problem in Bühl was that the New Orleans marriage certificate in Hebrew - even translated - legally wasn't guilty in Baden. Here since 1806 a civil marriage was the standard. Although people mainly had a ceremony in church or in synagoge, a written copy of the marriage record in church or synagoge was sent to the Bezirksämter (regional offices) of the Großherzogtum Baden (so called Standesbuch, -bücher). So there are a) Kirchenbücher (church books) and b) Standesbücher (civil record books) in Baden - a practise that lasted from January 1810 to January 1870. Civil offices (Standesamt, -ämter) in Baden were installed in 1870, and since 1873 in all countries of the German Empire (Deutsches Kaiserreich). -

Due to these legal rules in Großherzogtum Baden Joseph as a citizen of Bühl (Bürger in Bühl) and his wife Breine/Bienchen from Bubenheim after nearly ten years of matrimony had to marry again, otherwise their children would officially have been considered as illegitim or not born in matrimony. By the way: In the opinion of the Baden officials the couple didn't live in matrimony for nearly ten years!

So their second marriage took place on 21th October 1863 in Bühl:

"(...) Nachmittags wurde dahier getraut: Jsajas / Josef / Gernsbacher, ehel. Sohn des hiesigen verst. Handelsmannes Aron Hirsch Gernsbacher u der verst. Rosina Aa dahier, geb. den 6. Jenner 1824, hiesiger Bürger u Handelsmann, und Bräune / Bienchen / Kahn geb. zu Bubenheim in Rheinbaiern am 24. Dezember 1829, ehel. Tochter des dortigen Maklers Jakob Kahn und der verstorbenen Johannetta Marx. Zeugen sind: Emanuel Traub, hiesiger Vorsänger und Moses Schott, Handelsmann dahier. Unmittelbar nach der Trauung erklären die Eheleute vor dem unterzeichneten Rabbiner und den oben genannten Zeugen, daß sie bekanntlich und laut ihres beglaubigten hebräischen Ehescheines schon vor bald zehn Jahren in Neuorleans getraut worden sind, und sich der heutigen Trauung nur unterziehen, um den diesseitigen landesherrlichen Vorschriften zu genügen u um ihren Sohn Aron, welcher am 10. Mai 1855 in Neuorleans geboren worden ist, ferner ihre Tochter Sophie, welche am 21. August 1862 vormittag acht Uhr dahier geboren u im hiesigen Geburtsbuche pag 124 sub No 7 eingetragen worden ist, hiermit als ehelich zu erkennen und zu erklären. Bühl 21. October 1863.
