Biography

Maria was a daughter of Robert B. Debnam and Margaret Slater. Maria married Henry F. Hubbard when she was about 24 and he was about 45. All records indicate that she was born in 1844, not 1848 as shown on her grave marker.

State Court Rules In Mixup Over $512,285 Stockton Will^[1]

The execution of the bizarre will of the late Mrs. Maria S. Hubbard of Stockton, San Joaquin County, today advanced another step with a ruling by the third district court of appeal upholding a right to the estate by her only surviving daughter, Mrs. Eliza H. Emery, and 82 year old widow.

The trust estate was valued at $512,285.34 when the will was written in 1910. Some reports claim it now is worth triple that amount. Others maintain it is worth less than $500,000.

Provision Given

The will provides:

1. If Adelbert Cronise, husband of Maria Hubbard, Mrs. Hubbard's other daughter, died before Maria, and Eliza still were alive, Maria would received one half of the trust estate free and clear of the trust.

2. If W. W. Middlecoff, Eliza's husband, died before Eliza, and Maria still were alive, Eliza would received one half of the estate.

3. If Maria died before her husband, then upon the death of Middlecoff, Eliza would take all of the estate if living, of if dead it would go to Eliza's issue.

4. If Eliza died without issue before Middlecoff, then upon the death of Cronise, Marie would get all of the estate.

Cronise died in February 1933, and Maria died in August 1951, Eliza had divorced him and remarried. Eliza has two sons, Henry H. and Robert F. Middlecoff.

Appeal Expected

The action of the third district court of appeal in upholding the San Joaquin County Superior Court granting of the remainder of the estate to Eliza is expected to be appealed to the state supreme court. The superior court held the trust terminated with the death of Middlecoff.

Other litigants in the case are the Stockton Savings and Loan Bank, Security Trust Company of Rochester, NY, and the Bank of America.
