Biography

Zachariah Henry Bailey (see research note re: Middle Name) was born 10 October 1794 in Botetourt County, Virginia (see research note re: Birth Information) to James S. Bailey Sr. and Margaret Stinson (see research note re: Parents).

On 8 February 1815 Zachariah joined Captain Timothy Dalton's Company in the Virginia Militia with the rank of Private. The War of 1812 between the United States and Britain had been ongoing for nearly three years when Zachariah joined the military. Just a few days later, however, the Treaty of Ghent would be ratified, thus formally ending the War of 1812. Zachariah was released from the military on 3 March 1815[1]. Despite his service being brief, and him not participating in any battle or skirmishes[2], his service was sufficient for him to be granted 160 acres of land[3], a survivor's pension[4], and then a widow's pension[5] after his death (see research note re: Military Service).

In the 1820 Federal Census, Zachariah was living alone in Grayson County, Virginia[6] (see research note re: Analysis of Zachariah within Early Census Records).

On 29 March 1821, Zachariah married Hester Amburn in Grayson County, Virginia[7]. In the 1830 Federal Census, Zachariah continued living in Grayson County, Virginia[8]. It is likely that Hester and their two children were also in Zachariah's household. Unfortunately, Hester passed away in July 1831[9]. It is not clear whether Zachariah and Hester had any other children besides the two that were counted in the 1830 Federal Census. To date, the names of those children are not known, nor is it known what became of them after Hester's death.

On 14 June 1832, Zachariah married Rachael Glandon in Grayson County, Virginia[10][11]. Rachel was born about 1813 in either North Carolina or Virginia to Jacob Glandon and Martha Hiatt (see research note re: Parents of 2nd Wife Rachel Glandon).

By 1840, Zachariah had moved to Tazewell County, Virginia. In the 1840 Federal Census, Zachariah was living next to Rachel's father, his new father-in-law, Jacob Glandon[12]. It is likely that Rachel, and their first four children (Martha, John, Mary, and Zachariah Jr.) were also in Zachariah's household.

In the 1850 Federal Census, Zachariah and Rachel lived in Tazewell County, Virginia. Zachariah's occupation was farmer. Also in the household were eight of their children[13]. Rachel's parents, Jacob and Martha, were living three households away[14].

In the 1860 Federal Census, Zachariah and Rachel lived in McDowell County, Virginia. Zachariah's occupation was farmer. Also in the household were nine of their children[15].

In the 1870 Federal Census, Zachariah and Rachel lived in Elkhorn Township in McDowell County, now part of West Virginia. Zachariah's occupation was farmer. Also in the household were three of their children (John, James, and Cosby), and their grandchild Floyd (his name was actually Cloyd, and he was the son of John Asbury Bailey and John's first wife Sarah Virginia Brunty)[16]. The family of their son, Zachariah Jr., lived next door, including Rachel's father Jacob[17].

In the 1880 Federal Census, Zachariah lived in the household of his son James. Also in the household was James' wife Arabelle, and three of their children. Oddly, Zachariah was noted as being a widower and his second wife, Rachel, was not listed in the household[18]. Rachel, however, would not pass away until 1902[19].

Zachariah was 89 years old when he passed away. He died on 7 April 1884 in McDowell County, West Virginia[31] (see research note re: Death Date). He is buried in Franklin Cemetery located in McDowell County, West Virginia[32].

Middle Name

All but one of the sources used in this profile provide no middle name for Zachariah [1][2][3][4][5][6][7][8][9][10][11][12][13][15][16][18][19][31][33][34][35][36][37][38][39][40][41][42][43][44]. His Find-a-Grave profile uses the middle name of "Henry"[32]. The Find-a-Grave profile also includes two photos of grave markers:
  1. what appears to be an older gave marker with the name "Zachariah Bailey".
  2. what appears to be a more modern military grave marker with the name "Zachariah Henry Bailey".

Birth Information

A record for Zachariah's birth has yet to be located. His Find-a-Grave profile indicates that he was born on 10 October 1794 in Botetourt County, Virginia but provides no sources for that information[32]. The Find-a-Grave profile also includes two photos of grave markers:
  1. what appears to be an older gave marker with a birth year of "1788".
  2. what appears to be a more modern military grave marker with a birth date of "Oct 10 1794".
Additionally, census records and pension claims for his military service in the War of 1812 provide these estimated birth years for Zachariah:

Parents

It appears to be generally accepted that James S. Bailey Sr. and Margaret Stinson are the parents of Zachariah. A source supporting this relationship has yet to be located.

Military Service during the War of 1812 and associated benefits

A detailed analysis of Zachariah Bailey's War of 1812 Pension Application (total of 73 images) can be found here. This analysis includes an overview of what is represented by the 73 images, a description of each image, a list of names found within the images, a detailed timeline of events, and a list of other facts supported by one or more of the images.
Zachariah was drafted[36] (possibly enlisted[37]) into the Virginia Militia in early 1815. His service was brief:
  • 8 Feb 1815 - Zachariah joined Virginia Militia[1].
  • 17 Feb 1815 (10 days of service) - Treaty of Ghent ratified, ending the War of 1812.
  • 3 Mar 1815 (24 days of service) - Zachariah released from the Virginia Militia[1].
Despite his brief service, Zachariah was granted 160 acres of land[3]. It is not clear whether Zachariah actually acquired this land, nor where it was located.
Acquiring a pension was more complicated. When the War of 1812 ended, military service needed to be at least 60 days in order to qualify for a pension. In 1878, however, Congress reduced the requirement down to 14 days of service[45]. After that change was made, Zachariah used the services of Washington D.C. based lawyer, George E. Lemon, to help him apply for a pension in April of 1878[38]. Unfortunately, in August 1878, the Pension Office denied this pension application because they deemed Zachariah's service as being too brief[39]. It took three years, but George Lemon successfully appealed the rejection, noting that Zachariah was paid for 24 days of military service. Zachariah's pension application was reopened in May of 1881, and approved in June of 1881[4]. It appears that his pension was accrued back to 9 March 1878[4] (the date of the Congressional Act that reduced the military service requirement down to 14 days), and he received a pension until his death in 1884.
In November 1886, about two years after Zachariah's death, his widow Rachel applied to receive a widow's pension based on Zachariah's military service[40]. She did not obtain the services of a lawyer, and her initial application was denied as a result of several issues: signatures in pencil instead of ink, lack of written testimony regarding her inability to travel to a court of record, lack of proof that Zachariah's first wife was deceased, and lack of proof that she was still Zachariah's widow and had not remarried[41]. Even after correcting those issues, Rachel was informed by the Pension Office that written testimony must be witnessed by a Notary or Justice of the Peace, and that the validity of the witness must be certified by a court of record[42]. Rachel's persistence paid off and in June 1887 her revised application for a widow's pension was approved[5]. She received that pension until her own death in 1902[19].
Thirty five years after Rachel's death, her and Zachariah's son, James Wesley Bailey, inquired (via U.S. Congressman John Kee) into his eligibility to a pension, as the last living son of Zachariah[43]. There was no law supporting this claim, however, and it was denied[44].

Analysis of Zachariah within Early Census Records (1790 - 1840)

Zachariah Bailey was mapped through multiple early census records. This analysis starts with a proposed list of family members (spouses obtained from marriage records, children obtained from 1850 and 1860 United States censuses), and then adds assumptions (e.g. whether or not someone was present in the household in that census year, or in what age group an individual was counted, etc.) to that list in order to achieve the counts of family members, by age group and gender, noted in each census. Over the early census years (1790 - 1840), it is likely that Zachariah appeared in two households:
  1. Zachariah was likely in his father's household in 1790, 1800, and 1810. Candidate census records for Zachariah's father in these years have not yet been located.
  2. Google Sheet for household of Zachariah Bailey. Zachariah's military service started and ended at the courthouse for Grayson County, Virginia in 1815. Zachariah also married his first wife (Hester Amburn) in Grayson County, Virginia in 1821. It seems logical that he would be found in Grayson County, Virginia in the 1820 Federal Census. After his marriage to Hester in 1821, they started a family and can be found in Grayson County in the 1830 Federal Census. When Hester passed away in 1831, Zacheriah married again and then moved to Tazewell County, Virginia. His new father-in-law was enumerated next to him in Tazewell County in the 1840 Federal Census. Only a few very minor assumptions must be made in order to fit Zachariah's family to these 1820, 1830 and 1840 Federal Census records.

Parents of 2nd Wife Rachel Glandon

A record that explicitly supports Jacob Glandon and Martha Hiatt as the parents of Rachel Glandon has yet to be located. Instead we are relying on the following records as indirect support for this relationship:
  • Jacob Glandon married Martha Hiatt in 1812[46]
  • One image within Rachel's application for a widow's pension notes that Zachariah and Rachel were married in the home of Jacob Glandon.
  • Zachariah and Rachel lived next to, or very near to, Jacob and Martha in the 1840[12] and 1850[13] Federal Censuses.
  • In the 1870 Federal Census, Jacob lived in the household of Zachariah and Rachel's son Zachariah Jr.[17], right next door to Zachariah and Rachel[16].

Death Date

Zachariah's widow's application for a war pension[31], and Zachariah's grave marker[32], both indicate that he passed away on 7 April 1884. His Find-a-Grave profile, however (which includes a photo of his grave marker), indicates that he passed away exactly ten years later, on 7 April 1894[32]. The Find-A-Grave profile provides no source in support of the later death date.
