James and Rose James applied to lease land in the Fish River district in 1837, and in 1854 (In 1854 1 Feb 1853 Land proclamation – James was granted 4 lots in Fish River area) he bought three 30 acre blocks near the source of Fish River Creek and acquired numerous other blocks until 1859 when his estate was considerable.
James was charged and acquitted of cattle stealing in 1851 [1] CATTLE STEALING. James Grady was indicted for stealing at Kelso, on the 14th of June, three cows, each valued at forty shillings, and' one ox, valued at twenty shillings, the property of William Lee, the younger. The prisoner was defended by Mr. Hol royd ; attorney, Mr. M'Intosh. The evidence in this case showed, that in June last Mr. Lee had three cows branded TK on one side, and WL on the other. They were in the habit of running in Mr. Lee's paddock, but were left out one night by mistake, and were immediately after missed. The possession of cattle of the same brand and description was traced to the prisoner, who had been trying to dispose- of them, he being rather the worse for liquor at the time. It also appeared that the prisoner had purchased cattle from Thomas Casey, who branded TK, and it was suggested that he might have taken these cattle by mistake, being rather under the influence of liquor at the time, which view of the case was strengthened by the fact that he had immediately after let the cattle go, but did not take the cattle back to Mr. Lee's, and they were some time after impounded from the estate of William Lawson, Esq. Verdict, not guilty.
