Biography

Adam Chisholm was b. abt 1735/40 likely in Hanover Co, Va. Based on the ages and names of his children, it appears he may have been married twice. The names of his wife or wives are not known at this time.

PARENTS:

It is presumed that his father is Adam Chisholm b. abt. 1690 of Hanover Co, Va, known by researchers as "The Jacobite". This is not confirmed. He could be the son of John Chisum m. Eleanor Gillentine of Amelia Co, Va. The records do not confirm which he descends from, but the names of his children and his neighbors he did business with point towards Adam Chisholm of Hanover Co, Va.

Based on the age of Adam Chisholm’s son, David Chisholm b. abt 1764, we know that Adam Chisholm most likely was at least 20 years old when David Chisholm was born – placing Adam Chisholm’s year of birth before 1744. The following records and deeds show Adam Chisholm on an account at a store in Hanover County in 1756, and witnessing two separate deeds in 1760 and 1764 in Louisa County, Virginia. This may be the Adam Chisholm of this page – OR they may be deeds that were witnessed by Adam Chisholm who immigrated to York County, Virginia in 1716.

(Note: There are two gaps in time in the records – the elder Adam Chisholm is seen in records until 1745 – then there is an 11 year gap from 1745 to 1756 until we see the following records from 1756-1768 in Hanover/Louisa – then there is a 14 year gap from 1768 until 1782 when the younger Adam shows up again in Amelia County, Va. Research is still ongoing – so additional records may uncover where each Adam was during these time-periods).

The following records from 1756-1768 could possibly be either the elder or younger Adam Chisholm – the records themselves do not indicate which one it is – for now I have assumed these are for the younger Adam – as new records are uncovered, this page will be updated.

HALIFAX COUNTY, VIRGINIA

Records in Halifax County, Virginia show that Adam Chisholm has moved to that county by 1782, and has his son David Chisholm with him there. In 1783 we see Adam Chisholm purchase 100 acres of land. In 1786 we see him sell 100 acres and a 13 acre tract of land (at this time I haven’t located the deed showing when he purchased the 13 acres – possibly prior to 1782).

(NOTE: Unfortunately the deed available online doesn’t give the exact price paid for this land, but it is at least 1500 pounds paid for this 100 acres of land – which seems like a high price for the time for 100 acres. Looking at Terrible Creek, the beginning of Terrible Creek starts at the County Seat of Halifax, Va – and heads northwest from there. If the land was close to the city, maybe it was more valuable due to the location. Either way, it seems like 1500 pounds for 100 acres is quite a bit for a person about 29-30 years of age – if Adam was born in 1753. Another concern is where has Adam been prior to his records in Halifax Co, Va? It is possible he was in Hanover Co, Va – where most of the records are gone – additional tax records prior to 1782 may be available in Hanover that may answer this question).

The upper fork of Terrible Creek described in the deed is likely referring to Little Terrible Creek – as that is the only major fork feeding Terrible Creek. This is likely the area where Adam Chisholm lived while in Halifax County, Virginia.

ADAM CHISHOLM OF UNION COUNTY, SC’S YEAR OF BIRTH & CHILDREN

Adam Chisholm’s home in Union County, South Carolina was at Grindal Shoals, where he first appears to have purchased land along with John Watson in 1786 from John Grindal. His daughter Nancy Chisholm married John Smith, son of Abraham Smith of Smiths Ford. Abraham Smith had moved from his ancestral home at Smiths Ford down to Thickety Creek – close to Adam Chisholm’s home at Grindal Shoals.

John Smith and wife Nancy Chisholm Smith had one known daughter, Elizabeth Smith – who married Drury B. Going/Goyen – who was born and raised near his family home at/near Lockhart Shoals (located near the corner where Union, York, and Chester Counties all converge).

Age & Children of Adam Chisholm:

In reviewing Adam Chisholm of Union County, SC the research on this particular individual did not appear to have been complete. (Based on my review of what is available online). The records of his son David indicate David was born by 1764 or before – indicating Adam’s year of birth is likely 1743 or before – the records of Louisa County, Virginia indicate that this Adam Chisholm was likely born between 1730/35.

Note: Prior researchers estimated Adam’s year of birth to be about 1753 (but they had not put together the records showing David Chisholm of Union Co, SC and Halifax Co, Va was his son). There are no birth or baptism records that have been found for Adam Chisholm of Union County, SC that I have seen – so any statement about his age is an estimate (including my own).

The first record reviewed in Union County, SC that helps reveal Adam Chisholm’s age is David Chisholm’s will written in 1791 in Union County, SC and probated in 1792.

The following records confirm that David Chisholm who wrote his will in 1791 and died some time in 1792 in Union Co, SC was the son of Adam Chisholm of Union County, SC. See:

David Chisholm’s will directs that his “negroes and stock” are to be disposed of when his brother “Samuel arrives at the age of 10 years”. We find the distributions of David’s “negroes and stock” taking place in 1797, meaning Samuel has turned 10 years of age in 1797. This places Samuel Chisholm’s year of birth at 1787. Executors of David Chisholm’s will are Obadiah Trimmier and William Chisholm – who witness or are involved in the following 3 transactions in 1797 related to David Chisholm’s “negroes and stock” from his estate:

1797 June 2 – Adam Chisholm of the State of South Carolina and County of Union acknowledge myself indebted to John Henderson, Obediah Trimmer and William Chisholm executors of the estate of David Chisholm deceased in the sum of 55 pounds sterling to be levyed of my goods and chattles lands and tenaments if the said Adam Chisholm shall fail in the condition under written.
The condition of the above obligation is such that whereas Nancy Chisholm daughter of the above named Adam Chisholm being now under age, did on the 4th of this instant purchase of the above executors one negro girl named Lucinda the property of the above estate at the price of 55 pounds no if the said Nancy Chisholm when she arives at the age of 18 years comply with the terms of sale and with the true intent and meaning thereof then the above obligation to be void as else to remain in full force in law.

(Note: This conveance verifies that Adam Chisholm has a daughter named Nancy Chisholm that is not yet 18 years of age in 1797. Notice also that David Chisholm’s 1791 Will talks about his “brothers” and “sister” singular. It appears that Adam Chisholm had just one daughter. It also confirms that Watt Chisholm was one of the legatees of David Chisholm – meaning he was another brother of David’s).

Adam Chisholm of Union County, SC is the only Chisholm in this family line, or in the area of Union/Chester/York/Spartanburg Counties that has a son named “Samuel Chisholm” that is born near the year of 1787.

Adam Chisholm’s probate paperwork (see below) verifies that he has a son named Samuel Chisholm. As the Samuel Chisholm in David’s will is David and William Chisholm’s brother, and Adam Chisholm is the father of Samuel Chisholm – this means Adam Chisholm is the father of David Chisholm who died in 1792 in Union County, and is also father of William Chisholm who was executor of David’s will, and father of Samuel Chisholm who turned 10 years of age in 1787 as show in Adam’s probate records below.

David Chisholm is not mentioned in Adam Chisholm’s probate paperwork as David Chisholm died in 1792 unmarried and without issue. William Chisholm is unaccounted for as well in the probate papers at the time of this writing, but it appears he too may have died prior to Adam Chisholm’s probate in 1817 – (or William Chisholm may have moved from the State, and may have received his share of his father’s estate prior to moving from the area). David Chisholm is on Adam Chisholm’s tithe/tax list in 1784, and then David Chisholm shows up on his own tax list entry in 1785 – indicating he is now no longer considered a minor (has turned 21 years of age).

Since David Chisholm, son of Adam Chisholm was b. abt. 1764, his father Adam Chisholm most likely was born around 20 years before that by 1744 or before.

We know this is not David Chisholm Jr son of David Chisholm Sr in Hanover County, Va – because David Chisholm Jr is alive beyond 1791 – and shows up in Hanover County, Va on tax lists for the first time in 1796. His 1810 US Census entry in Chester Co, SC places his age at 26-44, meaning he is no older than b. 1776 – too young to the the David Chisholm who was with Adam Chisholm in Halifax Co, Va. As Adam Chisholm of Union County, SC was b. at least by 1744 or before, then he is too old to be David Chisholm Sr’s son. That raises the question of what relationship he has with the Chisholms of Hanover County, Va. He appears to be a brother of David and Walter Chisholm. He may be a cousin. At this time the best guess is they are siblings – but additional research may uncover new information that confirms the relationship.

The above entry shows that William Chisholm rode to “Augusta” on estate business for David Chisholm’s estate in 1792. This raises the questions – which “Augusta”? The condition of the above obligation is such that whereas Nancy Chisholm daughter of the above named Adam Chisholm being now under age, did on the 4th of this instant purchase of the above executors one negro girl named Lucinda the property of the above estate at the price of 55 pounds now if the said Nancy Chisholm when she arives at the age of 18 years comply with the terms of sale and with the true intent and meaning thereof then the above obligation to be void as else to remain in full force in law.

(NOTES: Which David Chisholm is this? This question leads to clues about Adam Chisholm of Union Co, SC)

First, David Chisholm Sr, from Hanover Co, Va, dies in 1805 according to Louisa County, Va Chancery Court records – see 1805 transactions below on this page. So this is not David Chisholm Sr.

David Chisholm Jr, from Hanover Co, Va is alive and well after 1792 and involved in many land transactions in Louisa Co, Va – see this page below. David Chisholm Jr – son of David Chisholm Sr – moves to Chester County, South Carolina and dies there in 1815 (see transactions below) according to his probate paperwork. So this is not either one of those two David Chisholms.

This David Chisholm is a son of Adam Chisholm. He has a brother in 1792 that is not 10 years old yet, and he makes his distributions hold until Samuel Chisholm reaches the age of 10 – which appear to happen in 1797, meaning Samuel Chisholm was born in 1787. Additionally, this David Chisholm’s will indicates he has 1 sister (singular). Adam Chisholm has one daughter – Nancy Chisholm.

Most of the distributions appear to go through Adam Chisholm – even though he is not a named executor. The executors of David Chisholm’s estate go through Adam Chisholm in most of these transactions. It is possible that Adam Chisholm gave his older children their share of his estate before he died – when it appears some may have moved out of the area. This may have been what led to the confusion of the executors of Adam Chisholm’s estate when they did not distribute Nancy Chisholm’s share of her estate to her. They may have assumed she had already received her part of Adam Chisholm’s estate. This division of older and younger children leads me to believe Adam Chisholm had a 2d wife – leading to the division in ages of his children. The older children may have received an inheritance from their mother’s side of the family upon her death – and Adam Chisholm may have given them their share of the estate early as they married and started their own families.

The distributions from the David Chisholm estate starting in 1797 plus Adam Chisholm’s estate in 1817 indicate he has the following children: William Chisholm, David Chisholm, The’s W. Chisholm, who all predecease their father Adam Chisholm – his children alive when Adam dies are named in his estate in 1817 – John Chisholm, Nancy Chisholm, Obediah Chisholm, and Samuel Chisholm.

In the 1791 will, David Chisholm states his brother, Samuel Chisholm, in 1791, is not yet 10 years of age, and that the will distributions are not to be devised until his brother Samuel Chisholm reaches the age of 10. The distributions occur in 1797 – meaning Samuel Chisholm, brother of David Chisholm was born in 1787. This is the same age as the Samuel Chisholm that is the son of Adam Chisholm – and Adam Chisholm’s estate names Samuel Chisholm as Adam’s son in 1817.

Additionally, David Chisholm’s will indicates the distribution is to be among his brothers and “sister” – singular – meaning he only has one sister. Adam Chisholm’s estate shows him to have one daughter – Nancy Chisholm.

David Chisholm’s will names 2 brothers – Samuel Chisholm b. abt 1787 (meaning he is about 4 years old when David Chisholm dies), and William Chisholm, who is an adult that is to be an executor in the will.

In 1794-1797 there are several transaction related to slaves that appear related to Adam Chisholm. Watson Chisholm and Adam Chisholm appear to both purchase the same slave named “Adam” within a few days of eachother from a Fields Blacky. John Watson is the person who purchased the 400 acres on Grindal Shoals with Adam Chisholm. Watson Chisholm appears may be a child of Adam Chisholm, and his first name a hint at who his wife may have been. He appears to have purchased the land with an in-law, and one of his children is named after the Watson family. John Watson Sr appears to be a father-in-law or a brother-in-law of Adam Chisholm.

Another clue as to a family relationship is the naming of one of Adam Chisholm’s sons as Obediah Chisholm. “Obediah” does not appear to be a family name from the Chisholm side, but Obediah Trimmier is an executor in David Chisholm’s estate. There is likely a family relationship – possibly Obediah Trimmier has married into either the Watson or Chisholm family. Obediah Trimmier’s records seem to show him to be born in the 1760s – so he is younger than Adam Chisholm – but the Trimmier (Trimmyear also) family may also be related to the Chisholm’s by marriage. It appears Adam Chisholm may have named his son after Obadiah Trimmier – as I see no other Obadiah’s in this line of Chisholms.

In 1797 Adam Chisholm sells a slave to a Watson Chisholm. The sale is witnessed by the executors of David Chisholm’s estate – Obadiah Trimmier and William Chisholm.

In 1797 the executors of the estate of David Chisholm decd, convey the slave named Fanny to The’s W. Chisholm – this is pursuant to David Chisholm decd’s estate. The’s W. Chisholm is Theophilus Watson Chisholm (same as Watson Chisholm) a sibling of David’s, and as such, appears to be a son of Adam Chisholm.

In 1797 a slave out of David Chisholm’s estate is conveyed to Nancy Chisholm, daughter of Adam Chisholm – she is still a minor at this time.

This also calls into question the commonly listed age of this Adam Chisholm. He appears to be older than what is listed by most researchers – meaning he may be a brother of David Chisholm Sr – not his son – continued research may uncover additional clues).

The following 1800 US Census shows a William Chisholm aged 16-25 years of age in Union Co, SC (meaning born between 1775-1784).

We know from David Chisholm decd's estate paperwork in Union Co, SC that William Chisholm was an adult by the year 1791 as he was the executor of the estate of David Chishom decd - so his year of birth is 1770 or before. This is evidence of another younger William Chisholm/Cissm living in the area - possibly a grandson of Adam Chisholm's.

Adam Chisholm was attached to answer to John Montcreif, Alexander McBeth & John Beckham Jr in a plea otherwise called John Beckham & Co in a plea of Debt and whereupon the said John Beckham & Co by their atty Abram Nott complain that the said Adam Chisholm on the 17th day of August in the year of our Lord 1797 at Union Court House in the Dist and State afsd made his said promissory note in writing subscribed with his own hand by which he promised to pay to the said John Beckham & Co 35 pounds 16 shillings and 1 penny for value recd to be paid on or before the last day of Nov then next ensuing with interest from the date. By virtue of the premises ad of the Act of Assembly in such case made and provided the said Adam became indebted to the said John Beckham & Co the said sum of 35 pounds 16 shillings and 1 penny and being so indebted he the said Adam in consideration thereof afterwards towit the last day of November afsd undertook and faithfully promised that he would well and pay the same agreeable to the Terms and effect of the note aforesaid.
Nevertheless the said Adam the aforesaid sum of money 35 pounds 16 shillings and 1 penny has never paid nor any part thereof altho often required to pay the same. But intending craftily and subtilly to deceive and defraud the said John Beckham & Co. In this particular he thereto has and still doth altogether refuse to pay the same. Whereupon the said John Beckham & Co say they are injured and have sustained damages to the value of 71 pounds 12 shillings and 2 pence sterling etc. And therefore they bring suit etc.

William Chisholm, son of Adam Chisholm, predeceases his father in 1809. This aligns with Adam Chisholm's probate paperwork where David Chisholm, Theophilus Watson Chisholm, and William Chisholm, who all have predeceased Adam Chisholm, are not mentioned as living legatees in the probate papers.

COMPARE TO "BLIND JOHN CHISUM'S SON NAMED WILLIAM

Many researchers have claimed that "Blind John Chisum" b. abt 1774 is the husband of Ann Praytor Chisum. The records for Blind John Chisum show this is not correct.

William Chisum Sr’s (son of Blind John Chisum) records to date have been elusive. He is metioned in the estate paperwork of Blind John Chisum decd’s probate papers as an heir as “William Chism Sr” in 1830 when he gives his written notice to the court that he agrees to Lazareth Van as administrator of his father’s estate.

In his father’s Rev War Pension Application filed by his sister Nancy Chisum Fisher, she indicates that her mother had filed for her pension in 1848 and listed 7 children who were still alive at that time – William was not one of them – so it appears he must have died some time between 1830-1848.

If William Chisum, son of "Blind" John Chisum, is alive and signing as an heir to "Blind" John Chisum's estate in 1830, then he cannot be the William Chisholm who dies in 1809 in Greenville County, SC that was married to Ann Praytor.

PROBATE OF ADAM CHISHOLM DECD IN UNION CO, SC IN 1817

The accounting of Adam Chisholm decd's estate was not filed until 1826. Adam Chisholm's daughter Nancy had married John Smith, and filed a petition in 1826 claiming she had never received her distribution of her father Adam Chisholm decd's estate. The administrator appears to have gone back through his records to create and file the accounting of the estate. The 1826 record indeed confirms that Nancy Chisholm had not received her payment as legatee in the 1826 accounting.

DAUGHTER NANCY CHISHOLM SMITH'S LAWSUIT REGARDING FATHER ADAM CHISHOLM DECD'S ESTATE

Nancy Chisholm files suit against William B Nott & Elizabeth Fernandes (widow of Henry Fernandes) for a division of her father's real estate, which she did not receive any portion. William B. Nott purchased the land and then sold it to the Fernandes family. The claim is that they do not have clear title, as they have not purchased the rights from all the legatees of Adam Chisholm decd - they missed Nancy Chisholm.

Humbly complaining shew unto your honors that your orator and oratrix John Smith and Nancy Smith his wife formerly Nancy Chisholm, that in or about the ___ day of ___ in the year of our Lord one thousand eight hundred and ____ Adam Chisholm the father of your oratrix departed this life intestate, being at the term of his death siezed and possessed in fee of a valuable trat of land lying on Pacolet River near to Grindols Shoals which is now in the possession and for time past has been of the dfendants William B Nott and Elizabeth Farnandis and that the said Adam Chisholm at the term of his death left John Chisholm, Obediah Chisholm, Samuel Chisholm, and your oratrix then Nancy Chisholm his heirs at law … that partition and division yet remains to be made of the said land as your orator and oratrix have not as yet received their part of portion of said land and that the Defendants have by some means under claim your orators do not know have been receiving the whole of the rents and profits of said land which is very valuable without accounting in any manner whatever to your orators for that tract of the said rents and profits.
And your orators further shew unto your honors that John Smith the complainant and husband of your oratrix is unfortunately for him either entirely insolvent or nearly so and they are poor and bu a slender means of procuring a support and that the whole of the rest of the fortune of your oratrix which she received from her father’s estate has past into and through the hands of her husband the said John Smith and that he has not as yet made any settlement by any Estate on your oratrix.
The complainants therefore pray that the said land may be partitioned and divided and the share of the said Nancy the complainant settled on her to the use of herself and husband for the — and that the defts may account for rents and profits of the said lands and that the defts may answer this … and that a writ of subpoena issued …. may issue directed the said Defendants William B. In the name of God, amen, I William Trimmear of Louisa, being sick and weak but of sound mind and memory, make and ordain this my last will and testament in manner and form following,
First and Principally I recommend my soul into the hand of Alimight God that gave it to me, and my body to the erath to be decently buried at the discretion of my Executors hereinafter mentioned, And to my wordly Estate wherewith it hath pleased God to bless me with (after my just debts are discharged) I give and dispose of as followeth Vitz-
I lend to my loving wife, Lucy Trimmear during her natural Life the land and plantation whereon I now live and one negro woman named Jane, with all my stocks of evry kind, together with all my household furniture excepting two feather beds,
and at the death of my said wife me estate hereby Lent is to revert to my three daughters namely Ann, Elizabeth, and Mary (Excepting the land) to them and their heirs forever,
and in case either of my said daughters should die with Lawful Issue, it is my desire, that the said Estate should be equally divided among those that are living (and to heirs of those that are dead) to them and their heirs forever.
Item – I give and bequeath to my son Obediah Trimmear after the death of my said wife, the land and plantation whereon I now Live, with one feather bed and Furniture to him and his heirs forever.
Item – I give and bequeath to my son John Trimyear one–tract of land containing 400 acres in this county and lying on the Three Notcht Road, and one Feather Bed– and Furniture to him and his heirs forever. My will and desire is that my Negro man Jack should be sold at the discretion of my loving wife, and the money arising from such sale should be laid out in Negroes–and such negroes to be at the disposal of my Loving Wife during her Natural Life, and at her death to be equally divided among my above mentioned daughters.
I also Desire that my land on Fosters Creek should be sold in order to discharge my just debts, and the Balance of the money to be Laid out for a work horse for the use of my said wife and twenty pounds to my son John Trimyear to be allowed before said horse is purchased–
